Also on this side of the house in the fill material surrounding the house he pointed out a surface crack <br />that runs in a semicircular shape around the side of the house. The crack is not continuous but can be <br />traced almost the entire length of west side of the home. The crack is approximately 30 feet long and <br />two inches wide. There was no indication of any cracks in the foundation although there is only a small <br />portion of the foundation exposed for inspection. We did not inspect the inside of the home. Please <br />refer to the Division's inspection report dated August 5, 2014 for photographs of these features as <br />described above. The August 5`h inspection report serves to document the features that Mr. Hasstedt <br />has identified on his property within the mine permit boundary that he believes to be potentially <br />caused by subsidence from the Roadside Portals Mine. The Division inquired whether or not Mr. <br />Hasstedt would like to have his request for inspection kept confidential (Rule 5.02.5(2)), and he <br />indicated that he did not. None of the other property owners with land overlying the Roadside Portals <br />Mine have complained of subsidence related issues including the Ute Water Treatment facility located <br />adjacent to and immediately south of the Hasstedt property (Photograph No. 30). The Erickson and <br />Hasstedt properties had no surface disturbance associated with the mining but are considered to be <br />affected area due to their location overlying underground workings. The Erickson (16.2 acres) and <br />Hasstedt (13.8 acres) properties require further investigation and understanding of potential <br />subsidence and hydrology related impacts and will not be released via the SL -08 bond release <br />application. <br />The last issue brought up by Rudy Fontanari on the September 18, 2013 inspection was in regards to <br />future hydrologic problems if he should ever decide to run his water at full flow (which at one point <br />he indicated that he has in the past and the water seemed to disappear). He further indicated that his <br />land is farmable and if fully irrigated it could flood the mine and cause major problems with SCC's <br />mine water discharge point and also the possibility of waters breaking through the portals and <br />potentially impacting the Interstate 70 located below. SCC maintains and operates one permitted <br />CDPS discharge point which is comprised entirely of mine water inflow to the underground workings. <br />The inflow is gravity discharged to the Colorado River via Outfall 016 located at the low end of the <br />Northwest Intake Pool at the Roadside South Portal Mine. Based on visual inspection of the lower <br />diversion ditch, on September 18, 2013, it did not appear to be capable of conveying the water to the <br />area Mr. Fontanari states that he has irrigated in the past. The culvert at the county road was silted in, <br />the grade of the ditch needs to be improved below the culvert and the lower portion of the ditch needs <br />to be cleared of sediment and tumbleweeds (see Photograph No. 31). Maintenance would be required <br />for water diverted from Rapid Creek to be conveyed down to the Carey Pond via the lower ditch <br />operated by Mr. Fontanari. A discussion of the Carey Pond, the South Portal reclamation and the <br />South Portal french drain system is pertinent here. At some point following the SL -8 bond release <br />inspection, Mr. Fontanari cleaned the lower diversion ditch to make it functional for conveying water. <br />The ditch having been cleaned out was first observed during the Division inspection conducted on <br />June 11, 2014. <br />The South Portal dewatering pipe (Outfall 001) was cut off and valved in 2002 prior to sealing the <br />portals. This water that normally went to the Colorado River now flows to Outfall 016. <br />Approximately 6 cubic yards of grout was pumped into the South Portal dewatering pipe in January <br />2008. This should have been an adequate volume of grout to plug approximately 2,000 feet of the 4 - <br />inch pipe. However, the grouting did not achieve a complete plug of the pipe and water continued to <br />leak at less than 1 gpm. To control the leakage, the end of the pipe was capped off and encased in <br />Page 23 <br />
