Energy Fuels Coal Inc. Application for Bond Release — October 2015 <br />The DRMS proposed to approve Technical Revision No. 43 (TR -43) on September 28, 2015. TR -43 <br />terminated all water monitoring requirements at the Mine site; approval to cease water monitoring at <br />the Loadout Area was terminated previously by approval of TR -37. Details regarding the approval of <br />TR -43 are found in the public record for TR -43 (http://drmsweblink.state.co.us/drmsweblink/search.aspx?dbid=o), more <br />specifically in the following documents; <br />• 11/6/2014, EFCI Application for Revision, 7 pages <br />• 2/12/2015, DRMS adequacy review, 20 pages <br />• 3/24/2015, EFCI adequacy review response, 111 pages (Weaver Engineering Services Analysis <br />and Bishop/Brogden Report) <br />• 4/28/2014, DRMS 2nd adequacy review, 12 pages <br />• 8/28/2015, EFCI 2nd response, 79 pages <br />• 9/28/2015, DRMS Proposed Decision, 1 page <br />DRMS approval of TR -43 conclusively demonstrates that the Southfield Mine minimized onsite <br />hydrologic impacts and prevented offsite hydrologic impacts. <br />At this time, EFCI is not requesting approval or release of liability over the greater affected area of the <br />mine, excepting the affected area that is directly associated with the 102 disturbed acres considered in <br />this request. <br />SL -03 Request for Release of Well Sealing Costs <br />EFCI is also requesting a full bond release for costs associated with sealing a significant number of <br />drill holes/wells that are currently included in tasks 53 and 53A of the RN -06 reclamation cost <br />estimate. Well abandonment reports for these drill holes/wells were submitted to the DRMS on <br />November 18, 2014. The drill holes/wells are shown on Map 12 of the approved permit and are listed <br />below. <br />MW -8, MW -10, SF87-07, Liberty #2, Manley #3, Vento #2, Zenith #2, SR -46, SF -87-06, SR -7, SR - <br />22A, WW -186, WW -370, WW -250, WW -330, and SF -88-10*. <br />*SF -88-10 was field located/inspected with DRMS on 2/6/15 and was documented in the inspection report as sealed. No sealing is required. <br />Based on the RN -06 reclamation cost estimate, EFCI calculates approximately $25,680.00 in direct <br />costs and $7,036.000 in indirect costs for a total requested for release of $32,716.00 for the sealing of <br />these drill holes/wells. This amount is included in the total requested for release in the application <br />contents section above. <br />Conclusion <br />EFCI believes that a Phase I bond release is warranted for 9 acres, further described as the Loadout <br />pond areas, the substation reclaimed area, the road to the Corley well, and permanent ponds 4 and 5. <br />EFCI believes this application demonstrates that a Phase II/III bond release is warranted for 102 acres <br />at the Southfield Mine and Loadout. EFCI is requesting release of all further reclamation liability for <br />the 102 acres of reclaimed lands and permanent facilities and a total monetary release of $351,376.00 <br />of the cash reclamation bond held by the DRMS. <br />Surety Release No. 3 (SL -03) Southfield Mine <br />
