Energy Fuels Coal Inc. Application for Bond Release — October 2015 <br />As documented in the DRMS written findings for SL -01, 14.5 acres of reclaimed area was Phase I <br />bond released in 1997. An additional 3.2 acres were occupied by sediment ponds L-1 and L-2. These <br />ponds were regraded and re -seeded in 2014. The pond areas are not subject to the ten-year revegetation <br />liability period because they are areas of former sediment control structures. An additional area of 0.7 <br />acres for the railroad tracks that bisect the Loadout area brings the total acreage under EFCI liability at <br />the Loadout to 18.4 acres. <br />As documented in the DRMS written findings for SL -02, the Southfield Mine is divided into 11 distinct <br />reclamation areas as shown on Exhibit A of the findings. These areas further described as follows; <br />• portal and facilities area <br />• coal stockpile area <br />• Ponds 1 and 2 basins including the bone yard <br />• explosives bunker area <br />• reclaimed Newlin Creek topsoil stockpile <br />• roadside topsoil stockpile area <br />• borrow area, topsoil stockpile area, and subsoil stockpile area (adjacent to RDA) <br />• rock dust storage tank <br />• Pond 3 area <br />• south fan area (at end of Monarch fan permanent road) <br />• refuse pile (RDA) <br />Collectively, these areas comprise 68.6 acres, which were Phase I bond released (DRMS SL -02 <br />findings, April 2003). These acres do not include an additional 10.4 acres of permanent structures that <br />were also released from bond liability in SL -02. Please see Appendix L for a copy of the SL -02 <br />approval map showing the reclaimed areas which were Phase I bond released. <br />SL -03 Request for Phase I Bond Release <br />Please refer to the Southfield Acreage Table in Appendix K. In the third column of this table the Phase <br />I acreage status is detailed for all of the mine and loadout areas. At the top of the column, highlighted <br />in yellow, 12.8 acres remain to be Phase I bond released. For this application, EFCI requests Phase I <br />bond release for 9 acres. Those areas are highlighted in the third column in green. These areas are <br />generally described as the Loadout pond areas, the substation reclaimed area, the road to the Corley <br />well, and permanent ponds 4 and 5. Excluded are 3.8 acres of areas which are not eligible for Phase I <br />release at this time. <br />SL -03 Request for Phase II Bond Release <br />Please refer to the Southfield Acreage Table in Appendix K. In the fourth column of this table the <br />Phase II acreage status is detailed for all of the mine areas. At the top of the column, highlighted in <br />yellow, 106.3 acres remain to be Phase II bond released. For this application, EFCI requests Phase II <br />bond release for 102 acres. Those areas are highlighted in the fourth column in green. Excluded are <br />4.3 acres of areas which are not eligible for Phase II release at this time. <br />Site maps are included in Appendix E for the Mine site and the Loadout Area. Maps specific to other <br />technical data, written findings, and reports are included in their respective Appendices. Appendix I <br />includes the 2014 Annual Reclamation Report which provides a comprehensive history of the <br />reclamation management measures taken over the last 12 years. <br />Surety Release No. 3 (SL -03) Southfield Mine <br />
