(EFCI) is pleased to submit this request for bond release pertaining to the <br />Southfield Mine Site and Loadout Area located near Florence, Colorado. The accompanying <br />application was assembled as required by the applicable Rules governing coal mining and as further <br />recommended in the Division of Reclamation, Mining, and Safety document Guideline Regarding <br />Selected Coal Mine Bond Release Issues, April 18, 1995. <br />This is the third request for bond release over the life of the Southfield Mine. Two previous bond <br />release applications were approved in 1997 and 2003. Both of those requests were for Phase I bond <br />release. The attached application includes a request for Phase 1, Phase II, and Phase III bond release for <br />specific areas as described further in the application. <br />Current issues and recent permitting and regulatory actions may slightly modify this bond release <br />request during the time in which the application is under review and prior to any final decision on the <br />application. However, the resolution or outcome of those issues does not affect the vast majority of the <br />areas of the mine where reclamation requirements have been fulfilled in accordance with the approved <br />permit and for which this request is applicable. <br />Energy Fuels appreciates your prompt attention and cooperation in this matter.
