(Tri-State) is submitting the enclosed <br />"Application Form for a Revision to a Coal Mining and Reclamation Permit" for a technical revision <br />application on behalf of the Western Fuels -Colorado, A Limited Liability Company (WFC) New Horizon <br />Mine. Tri-State is the parent company of WFC. The New Horizon Mine operates under the Division of <br />Reclamation, Mining and Safety (DRMS) Permit No. C-1981-008. <br />TR -69 is being submitted to propose a new sediment pond (Pond 018) which will handle surface <br />water runoff from the facilities areas, topsoil stockpiles south of the facilities, and reclamation areas <br />where Mount Nucla material was once temporarily stored. In an earlier site inspection, you noted an <br />issue with the C4 ditch and the trees that have lined the ditch. It was verbally agreed upon that the trees <br />provided a benefit and should remain. TR -69 will propose a new ditch (Ditch C4A) to route disturbed <br />water to Pond 018 that previously flowed to the C-4 ditch. The long term plan for C-4 ditch is it will <br />remain, and will route irrigation water to Calamity Draw once the proper phases of bond release have <br />been achieved in the Pond 007 watershed. Once Phase II release has been achieved and WFC can <br />relinquish sediment control structures in the Pond 007 watershed, the C-4 ditch will be routed directly to <br />Calamity Draw. <br />Also enclosed please find a revision application and a change of index sheet to ease incorporation <br />of these materials into the permit.
