Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to <br />partially approve Bond Release Application No. 8 (SL -8) for the Roadside Portals, Permit No. C- <br />1981-041. This application is a request for release of Phase I, II, and III bond liability on both <br />disturbed and undisturbed acres located within the permit boundary at the Roadside North and <br />South Portals Mine. The following acreages are being proposed for release: Phase I: 22.2 acres; <br />Phase IL 136.5 acres; Phase III: 128.0 acres; undisturbed acres overlying underground workings: <br />744.0 acres; and unaffected acres: 1288.9. Total Disturbed acres to be released will be 128.0 <br />acres. Total Affected acres to be released will be 872.0 acres. The Division is proposing a <br />release of reclamation liability in the amount of $663,429.00. Snowcap Coal Company has <br />agreed to not request return of any bond monies associated with this approved reduction in <br />reclamation liability until such time as issues related to potential hydrologic communication are <br />resolved. The underground operation is operated by Snowcap Coal Company, Inc under the <br />provisions of the Colorado Surface Coal Mining Reclamation Act of 1979. The bond release <br />application was submitted by Snowcap Coal Company, Inc on September 4, 2013. The affected <br />area is located in Mesa County, approximately 5 miles North of Palisade, Colorado. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, <br />Mining and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and on the <br />Division's website at <br />http://mining.state.co.us/Reports/MiningData/Pages/ImagedDocumentData.aspx. Requests for a hearing must be made in writing within <br />thirty (30) days of the first publication of this notice, and shall state with reasonable specificity the <br />reasons for the request and objections to the proposed decision. <br />
