Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding issues <br />that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny this application. <br />6.4.5 Exhibit E — Reclamation Plan <br />1. The Applicant has indicated a portion of the Pfeiff Pond was inadvertently mined outside of <br />the permit boundary. Pursuant to C.R.S. 34-32.5-116(4)(1), areas outside of the affected land <br />shall be protected from slides or damage occurring during the mining operation and <br />reclamation. A possible violation for failing to protect areas outside of the affected land will <br />not be pursued at this time. In order to bring the site into compliance, the Operator must <br />revise the Amendment Application which is currently under review to increase the affected <br />area, such that all of the Pfeiff Pond is included within the permit boundary. <br />Pursuant to Rule 1.8, an Applicant may amend an application for a permit under <br />consideration by filing a copy of such amendment with the Division and placing a copy with <br />the County Clerk and Recorder. Any amendment to an application shall constitute a new <br />filing date for the sole purposes of determining the date for consideration of the application <br />by the Division, and for the deadline for a final decision on the application. As required by <br />Rule 1.6.6, the Applicant shall be required to publish and mail new notice of the application. <br />There is no fee required with an amendment to an application. <br />2. The Applicant has stated there will be additional backfilling for a portion of the Brownwood <br />North East Reservoir (BNER).
