The proposed technical revision of Morton Lakes Permit (M-2008-
082) will have no effect upon the approved reclamation plan nor will there
be any reclamation liability associated with the proposed relocation of the
primary access road as it is intended to serve as a permanent feature of the
property necessary to provide a permanent means of access to Morton Lakes
following the completion of reclamation.
RMCC has discussed the proposed access change with Weld County
planning staff which approved the proposed change of access as a "Minor
Amendment" to the existing Morton Lakes USR 1682.
The proposed Morton Lakes change of access was also reviewed by
the Colorado Department of Transportation who, like Weld County, support
the proposed change of access as a benefit to public health, safety and
welfare.
Based on the above, RMCC believes their proposed change of access
meets the Mined Land Reclamation Board's definition of a "Technical
Revision" as it will have no effect on the approved Reclamation Plan.
