<br />I, Randal Sunderland, do solemnly swear that I am managing
<br />editor of the Delta County Independent: that the same is a weekly
<br />newspaper printed, in whole or in part, and published in the County
<br />of Delta, State of Colorado, continuously and uninterruptedly in
<br />said County of Delta for a period of more than fifty-two consecu-
<br />tive weeks prior to the first publication of the annexed legal notice
<br />or advertisement; that said newspaper has been admitted to the
<br />United States mails as second-class matter under the provisions
<br />of the Act of March 3, 1879, and all amendments thereof, and that
<br />said newspaper is a weekly newspaper duly qualified for publish-
<br />ing legal notices and advertisements within the meaning of the laws
<br />of the State of Colorado; that the annexed legal notice or adver-
<br />tisement was published in the regular and entire issue of every
<br />number of said weekly newspaper for the period of one con-

<br />The Colorado Division of
<br />Reclamation, Mining and Safety is
<br />proposing to Approve the partial
<br />release of coal exploration recla-
<br />mation band liability for Notice
<br />Of Intent No, X-2011.223-11, Bond
<br />was submitted to cover rec)ama-
<br />tion Costs associated with explo-
<br />ration drill holes in Las Animas
<br />County. An inspection showed that
<br />all holes have been adequately
<br />abandoned and associated dis-
<br />turbances have been reclaimed
<br />with the exception of revegetation
<br />associated with Sites OM -12-35,
<br />QM -13-30, QM -13-18, OM -13-32,
<br />OM -13-13, and OM -12-27. The
<br />revegetation reclamation liabil-
<br />Ity at each site for a total of seven
<br />sites will remain. The Division cur-
<br />rently holds a Corporate Surety
<br />in the amount of $386,931.17 of
<br />which the Division approves the
<br />release of $383,089,27 under SL -1.
<br />$3841.90 is being hold after the
<br />approval of SL -1 for reyegetation
<br />and weed management costs. This
<br />release represents a partial bond
<br />release of $383,089.27.
<br />The legal description for the proj-
<br />ect is;
<br />Portions of Sections 9, 10, 11, 12,
<br />13, 14, 23, 24, 25, 26, 35 and 36,
<br />Township 13 South, Range 93
<br />West; Portions of Sections 7, 8, 9,
<br />15, 16, 17, 18, 19, 20, 21, 22, 28, 29,
<br />and 30, Township 13 South, Range
<br />92 West.
<br />Any Person with an interest which
<br />may be adversely affected by this
<br />Proposed decision may submit
<br />written comments, or a written
<br />request for an adjudicatory hearing
<br />before the Colorado Mined Land
<br />Reclamation Board, to the Division
<br />at 1313 Sharman Street, Aoom 215,
<br />Denver, Coloredo 80203. Such
<br />comments should be submitted
<br />within 30 days of tate Second publi-
<br />cation of this notice.
