September 29, 2015 SEP 2 9 2015 Mr. Tyler O'Donnell Division of Reclamation, Mining and Safety DIVISION OF RECLAMATION 1313 Sherman Street, RM 215 MINING AND SAFETY Denver, CO 80203 Re: Brannan Sand & Gravel Company Pit 29, Permit No. M-1980-183, Amendment to AM -02, Second Adequacy Review Dear Mr. O'Donnell: The following are responses to your second adequacy review dated September 25, 2015. For reference, your original comments are in italics. EXHIBIT L - Reclamation Costs (Rule 6.4.12): 5) The required finical warranty will be set at $1,377,450. The required financial warranty includes the cost from all reclamation tasked outlined in this permitting action and previously approved applicable permitting actions, the required finical warranty does not contain costs for any reclamation previously, completed. If the Operator would like to remove the rip -rap from around the reservoir shorelines the request must be done in a subsequent permitting action. The cost for the rip -rap will remain in the required financial warranty until it's removed through the appropriate permitting action. We understand the Division's position and will agree to the financial warranty amount for this amendment. General Ouestions and Comments: 8) On September 18, 2015 The Division received your submittal to the Preliminary Adequacy Review letter and a letter addressing the Objection received from Frei. On September 25, 2015, The Division received your letter regarding the datum shift. The Division is accepting and incorporating both the letter addressing the objection and the letter addressing the datum shift as part of the reclamation plan proposed in the Amendment No.2 Application.
