<br />'~JISTRICT COURT, WATER DIVISION N0. 5, COLORADO <br />--------------------------------------------------- <br />•, ~ <br />'Application No. 88CW131 <br />----------------------------------------------------- <br />RULING OF REFEREE <br />------------------------------------------------------------------------------- <br />IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF NEW CASTLE ENERGY <br />CORPORATION, IN THE COLORADO RIVER, IN GARFIELD COUNTY <br />------------------------------------------------------------------------------- <br />The above entitled Application was filed on June 23, 1988 and was <br />referred to the undersigned as Water Referee for Water Division No. 5, State <br />of Colorado, by the Water Judge of said Court on the 14th day of July, 1988, <br />in accordance with P.r*_icle 92 of Chapter 37, Colorado Revised Statutes 1973, <br />known as The Water Right Determination and Administration Act of 1969. <br />And the undersigned Referee having made such investigations as are <br />necessary to determine whether or not the statements in the Application are <br />true and having become fully advised with respect to the subject matter of the <br />Application does hereby make the following determination and Ruling as the <br />Referee in this matter, to wit: <br />1. The statements in the Application are true. The Referee has made <br />no determination with respect to the Statement of Opposition. <br />• 2. The name of the structure is Coal Ridge Pump and Pipe line. <br />~3.' 'The name and address ''of the Claimant: NeN Castle Energy <br />Corporation; c/o Charles M. Stoddard; P. 0. Box 697; Glenwood Springs, CO <br />8]602. ~ '' <br />4. The source of the water is the Colorado River. <br />5. "'The point of diver'sion'is located on the South bank of the Colorado <br />River in Section 35, T. 5 S., R. .90 W. of the 6th P.M. at a point 1260 feet <br />West of the East line and 1840"feet-North of the South line of said Section 35. <br />6. On June I1, 1984, in Case No. 83CW367, the-Water Referee for Water <br />Division No. 5 awarded to Coal Ridge Pump and Pipeline a conditional water <br />right of 2.0 cubic feet of water per second of time, to be used for municipal, <br />commercial, industrial, domestic, irrigation and recreation purposes, with <br />Appropriation date of September 14, 1983. The Claimant was directed to file <br />an Application for Quadrennial Finding of Reasonable Diligence in the <br />development of this .conditional water right in June of 1988 to maintain said <br />conditional water right in full force and effect. This Ruling of Referee was <br />confirmed and made a Decree of the Court on July 9, 1984. <br />7. On June 23, 1988, as directed by the Court in the original finding <br />of reasonable diligence, the Claimant filed, in Water Court for Water Division <br />~:o. 5, an Application for Quadrennial Finding of Reasonable Diligence in the <br />development of this conditional water right. <br />7~-7 <br />
