G. On October 31, 19'x',4, the Claimant. filed, in Water Court for Water
Uivrsiun No. 5, an Applicai,ion tut Change of Water- Right in which it is
rrqucsted that an alternate point of diversion be established for the water

Rrdyc• Pwnp and Pipc•iine a[ thn location as described in paragraph 5(b) above.
[n support of this request the Applicant has submitted a detailed outline
of [fie prucecdures which rill be followed to use the water in compliance with
the Decree in Case tlo. W-2127.
In Casc No. W-2127, the Court determined that the total consumptive use of
the Vulr.an Ditch rights has heen approximately 440 acre feet per year in dry
years, and thaC the 440 acre feet consumed historically is available for
consumption in Applicant's devflopment without injuriously affecting other
wa~er rights. The Court also finds drat the Applicant's water rights in the
Vulcan Ditch as above described may be used for year-around municipal use
(including commercial, industrial, domestic, irrigation incident thereto, and
sewage treatment including land disposal) irrigation, recreation, fish and
wildlife propagation, and all other beneficial purposes, including storage for
each of the above purposes.
In the same proceeding the f.ourt established alternate points of diversion
for the Vulcan Ditch water rights at Riverbend Wells No. 1 through No. 5.
By Warranty Deed, dated Dtay 2, 1963, and recorded in Book 626 at page 563,
of the Garfield County records, Hamilton R. Duncan, Jr. conveyed to Storm King
Dunes, Inc., the Applicant hereir•, the right to 395 acre feet of the annual
consumptive use previously decreed to the Vulcan Ditch water right in Case No.
W-2177.
In order to comply with the Decree in Case No. W-2127, the Applicant
t:erein has described the locations along the Vulcan Ditch at which points of
usr will be es[ablished for the purpesc of monitoring and measuring the
quantities of water and places of use of the Vulcan Ditch water right which is
the property of the f.pplicant, to-wit:
