~~ <br />-~~ ~1 <br />• DISTRICT COURT, WATER DIVISIOFi N0. 5, COLORADO <br />------------------------------------------------------------------------------- <br />Application No. 88CW232 <br />------------------------------------------------------------------------------- <br />RULING OF REFEREE <br />------------------------------------------------------------------------------- <br />IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF STORM KING MINES, INC., <br />IN THE COLORADO RIVER, OR ITS TRIBUTARIES, TRIBUTARY INVOLVED: UNNAMED, IFi <br />GARFIELD COUNTY <br />------------------------------------------------------------------------------- <br />The above entitled Application was filed on June 23, 1988, and was <br />referred to the undersigned as Water Referee for Water Division Flo. 5, State <br />of Colorado.: by the Water Judge of said Court on the 14th day of July, 1988, <br />in accordance with Article 92 of Chapter 31, Colorado Revised Statutes 1973, <br />known as The Nater Right Determination and Administration Act of 1969. <br />And the undersigned Referee having made such investigations as are <br />necessary to determine whether or not the statements in the Application are <br />true and having become fully advised with respect to the subject matter of the <br />Application does hereby make the following determination and Ruling as the <br />Referee in this matter, to wit: <br />1. The statements in the Application are true. <br />• 2. The name of the structure is Coal Ridge Reservoir. <br />3. The name and address of the Claimant: Storm King Mines, Inc.; c/o <br />Charles M. Stoddard, Esq.; P. 0. Box 697; Glenwood Springs, Colorado 81602. <br />4. The source of the water is the Colorado River through Coal Ridge <br />Pump and Pipeline and the Vulcan Ditch. <br />5. The center of the dam axis is located in Section 35, T. 5 S., R. 90 <br />W. of the 6th P.M. at a point 1,900 feet West of the East line and 210 feet <br />North of the South line of said Section 35. <br />6. The use of the water is municipal, commercial, industrial, <br />domestic, irrigation and recreation purposes. <br />7. The date of initiation of Appropriation is September 14, 1983. <br />8. The amount of water claimed is 2,000 acre feet of water, <br />conditional. <br />9. On June 11, 1984, in Case No. 83CW368, the Water Referee for Water <br />Division No. 5 awarded to Coal Ridge Reservoir, a conditional water right of <br />2,000 acre feet of water, to be used for municipal, commercial, industrial, <br />domestic, irrigation and recreation purposes, with Appropriation date of <br />. September 14, 1983. The Claimant was directed to file an Application for <br />Quadrennial Finding of Reasonable Diligence in the development of this <br />conditional water right in June of 1988 to maintain said conditional water <br />right in full force and effect. This Ruling of Referee was confirmed and made <br />a Decree of the Court on July 9, 1984. <br />7R-7 <br />
