COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />August 26, 2015 <br />Jerry Nettleton <br />Twentymile Coal, LLC. <br />29515 Routt County Road 27 <br />Oak Creek, CO 80467 <br />RE: Foidel Creek Mine; C-1982-056 <br />Minor Revision No. 289 (MR289) Adequacy Review No. 1 <br />Dear Mr. Nettleton: <br />The Colorado Division of Reclamation, Mining, and Safety (Division) received the MR289 application on <br />August 4, 2015. The Division deemed the application complete on August 25, 2015. The decision date <br />for the application is September 4, 2015. The following items will need to be addressed prior to the <br />approval of the revision: <br />1. Revised page 2.04-9.1 is currently also being revised with MR287. Given that the decision date <br />for MR287 and MR289 are the same date and to avoid confusion; please revise this page to <br />include the text from both revisions. Specifically, the section regarding the WCR Coal <br />Coreholes currently does not match the text submitted with MR287. Please revise this page to <br />include this information. <br />2. Proposed revised page 2.05-45.28 indicates that the Cultural Resource Survey for the proposed <br />activity is located in Exhibit 6T. However, as this survey also includes portions of the MR287 <br />disturbed area, TC has indicated with MR287 that this survey would be placed in Exhibit 6L. <br />Please revise this page to indicate this survey will be placed in Exhibit 6L. <br />3. Revised page 2.05-45.28 and 2.05-84.13 indicates 1 foot of soil material will be salvaged from <br />the borehole pad and that a maximum of approximately 1,500 cubic yards of soil will be <br />recovered. Exhibit 53-M6 and M7 maps indicates the borehole pad area is 1.2 acres. Given this, <br />the Division estimates about 1,900 cubic yards of soil should be recovered. Please revise these <br />pages to increase the estimated amount of soil to be recovered. Also, please revise Table 49A. <br />4. Please depict the upgradient diversion ditch to be installed on the north and east side of the pad <br />on the Exhibit 53-M6 and M7 maps submitted. <br />5. Enclosed is a copy of the reclamation cost estimate the Division conducted for this proposed <br />project.
