AFFIDAVIT REGARDING USE OF INERT FILL <br />STATE OF COLORADO ) <br />) SS <br />ADAMS COUNTY ) <br />David A. Lincoln, Vice President and Operator of Bennett Sand and Gravel, Permittee, <br />being duly sworn, states the following: <br />This Affidavit is provided in accordance with Rule 3.15(a) of the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board <br />Bennett Sand and Gravel, operated by David A. Lincoln, is requesting approval from <br />Adams County and the State of Colorado to import inert fill to Bennett Sand and Gravel <br />Pit #2 to provide adequate fill to conform to the approved reclamation plan. The inert <br />material will be placed as per the attached Facility Description, being submitted to <br />Adams County. The materials which are to be imported, meet the definition of "Inert <br />Material" as set forth in Rule 1.1(20) of the Mineral Rules and Regulations of the <br />Colorado Mined Land Reclamation Board, promulgated October 1995, as amended <br />David A.
