Mr. Baker explained that the dumpsters <br />and bins were for his solid waste business and that his interest in acquiring the site <br />was for storage of this equipment. <br />4. On July 24, 2014, Larry Laughery telephoned the Division to report <br />the permit had been "sold" to Mr. Lass. <br />5. On July 25, 2014, the Division informed Mr. Lass via telephone a <br />Succession of Operator ("SO") agreement is required to transfer the permit. <br />6. On November 10, 2014, SO -02 was filed with Division for Jay Baker, <br />Tiger Timber and Gravel, LLC, as successor operator. <br />7. On December 23, 2014, the Division inspected the site for the purpose <br />of determining the required financial warranty. <br />8. The Division calculated the financial warranty for the site to be $14,440.00, <br />an increase of $4,440.00 over the current financial warranty. <br />9. On December 31, 2014, the Division sent an SO approval letter to Mr. <br />Baker of Tiger Timber and Gravel, LLC, requesting that the $14,440.00 required <br />financial warranty be submitted within sixty (60) days. <br />10. On March 2, 2015 and again on April 9, 2015, the Division granted 30 - <br />day extensions to the deadlines for Tiger Timber and Gravel, LLC to provide the <br />required financial warranty, with a final deadline of May 1, 2015. <br />11. On May 11, 2015, the Division sent a Succession Denial letter to Tiger <br />Timber and Gravel, LLC. <br />12. On May 11, 2015, the Division sent a Surety Increase letter (written <br />notice of adjustment) to the Estate of Frank Laughrey, % Larry Laughrey, stating <br />that the increased financial warranty was due to be submitted within sixty (60) <br />days of the date of the letter, by July 10, 2015. <br />13. The Operator failed to submit the increased financial warranty by July <br />10, 2015 or at any time since. <br />14. On July 16, 2015, the Division sent a Reason to Believe a Violation <br />Exists and Notice of Board Hearing letter to Larry Laughrey, Estate of Frank <br />Laughrey, for failure to post additional financial warranty within sixty (60) days of <br />the date of notice of -adjustment. <br />Estate of Frank Laughrey <br />Tiger Timber Site, M-1991-082 <br />MV -2015-023 <br />V, <br />
