Reclamation Phase 2. The Operator testified that it received notice of the breach by <br />the same email that was sent to the Division. <br />5. The Division conducted an inspection of the site on July 2, 2015. <br />Connie Davis was present at the inspection to represent the Operator. Thornton <br />also had representation during the inspection. At the time of the inspection, the <br />Division observed a breach between the South Platte River and the southeastern <br />portion of Phase 2, allowing the river to flow overtop that portion of Phase 2. The <br />Division observed that the breach had eroded the upper portion of the slurry wall. <br />The breach diverted a portion of the South Platte River flow into Phase 2 and <br />throughout the reservoir complex. <br />6. During the inspection, the Division estimated that about one-third of <br />the flow of the river diverted into the pit, approximately 750 to 1500 cfs. The <br />diverted flow had completely filled all three phases of the reservoir complex and <br />was flowing over the earthen berms between all of the phases. The diverted flow <br />was circuiting through the reservoir complex and draining back to the river through <br />an emergency spillway that was constructed along the eastern side of Phase 4. In <br />addition, some of the excess flow was overtopping Phases 3 and 4, and flowing <br />directly back into the river. <br />7. On July 8, 2015, the Division received an email from the Operator's <br />representative, notifying the Division of a pit breach in Phase 3. The Operator's <br />representative informed the Division that the eastern bank of Phase 3 had failed and <br />explained the result was that water from Phase 3 was flowing back into the river. <br />8. The Division conducted a follow-up inspection on July 9, 2015 to <br />observe and evaluate the site conditions described by the Operator. The Operator <br />was notified of the inspection date and time, but was not present for the follow-up <br />inspection. Thornton did have representation at the follow-up inspection. <br />9. During the follow-up inspection on July 9, 2015, the Division observed <br />a breach between the eastern portion of Phase 3 and the river. The breach was <br />estimated to be approximately forty (40) feet wide. <br />10. The Division mailed an inspection report memorializing both the July <br />2 and July 9 inspections on July 10, 2015. The Division imposed the following two <br />corrective actions in the inspection report: (1) the Operator shall repair the breach <br />between the river and Phase 2 and return the river to the original channel within <br />ten (10) days after the mailing of the inspection report; and (2) the Operate shall <br />repair all damaged slopes and earthen embankments, replace the damaged sections <br />of the slurry walls, and provide a flood control mitigation plan to include an <br />armored inlet and outlet spillway structures for the entire reservoir complex to be <br />submitted as a Technical Revision no later than August 31, 2015. <br />Aggregate Industries — WCR, Inc. <br />M-1999-034 2 <br />
