E. <br />September 17, 2015 <br />Page 4 <br />Conditions of Approval <br />I hereby approve the substitute water supply plan in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of October 1, 2015 through September 30, <br />2016. If this plan will not be made absolute by a water court action by the plan's <br />expiration date, a renewal request must be submitted to this office by August 15, <br />2016. <br />2. Well permit no. 78820-F was issued for the Sandy Acres Pit, for the currently uses at <br />the site. This permit remains valid. <br />3. The total surface area of exposed ground water at the Sandy Acres Pit shall not <br />exceed 25.51 acres, resulting in an annual evaporative loss of 70.1 acre-feet. <br />4. Total consumption at the Sandy Acres Pit must not exceed the aforementioned <br />amounts unless an amendment is made to this plan. <br />5. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />6. All releases of replacement water must be sufficient to cover all out -of -priority <br />depletions in time, place, and amount and must be made under the direction and/or <br />the approval of the water commissioner. The release of replacement water may be <br />aggregated to maximize beneficial use if approved by the water commissioner or <br />division engineer. The water commissioner and/or the division engineer shall <br />determine the rate and timing of an aggregated release. <br />7. Conveyance loss for delivery of augmentation water is subject to assessment and <br />modification as determined by the division engineer. The applicant must provide 72 <br />hours advance notice and obtain approval of the water commissioner prior to release <br />of augmentation water, or less frequent if approved by the water commissioner. <br />8. Adequate accounting of depletions and replacement must be provided to the division <br />engineer in Greeley (Div1Accountin�Cstate.co.us) and the water commissioner <br />(William Schneider at William. Schneider@state.co.us) within 30 calendar days of the <br />end of the month for which the accounting is being made. All amounts shall be in <br />acre-feet and submitted accounting shall conform to the Administration Protocol <br />"Augmentation Plan Accounting, Division One - South Platte River" (attached). <br />In addition, the Applicant shall verify that the City of Aurora ("Aurora") has <br />submitted reports to the division engineer that include accounting of all <br />replacement water controlled by Aurora showing the total volume of water under <br />its control, and the amount committed to each of the recipients of the water, <br />including the water committed to this plan. <br />9. Water used for augmentation in this plan must be legally available for said use, <br />augmentation. It is the Applicant's responsibility to ensure that the replacement <br />
