Mr. Joe Kraig <br />,Reit SWSP <br />September 22, 2015 <br />Conditions of Approval <br />Page 3 of 5 <br />I hereby approve the proposed substitute water supply plan in accordance with 537-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan shall be valid for the period of September 1, 2015 through August 31, 2016, <br />unless otherwise revoked or modified. If this plan will not be made absolute by a <br />water court action by the plan's expiration date, a renewal request must be submitted <br />to this office with the statutory fee of $257 no later than June 30, 2016. <br />2. A well permit has been obtained for the current use and exposed pond surface area of <br />the gravel pit in accordance with 537-90-137(2) and (11), C.R.S., permit no. 62970-F. <br />3. Well permit no. 66319-F was approved pursuant to 537-90-137(2), C.R.S., for the <br />proposed operational uses. <br />4. Approval of this SWSP is for the purposes stated herein and pumping is limited to the <br />wells identified above. Additional wells and/or additional uses for the water that is <br />the subject of this SWSP will be allowed only if a new SWSP is approved for those <br />additional wells/uses. <br />5. The total surface area of the ground water exposed must not exceed 2.0 acres, which <br />results in a maximum evaporative annual loss at the Heit Sand and Gravel Mine of 5.82 <br />acre-feet. <br />6. The annual amounts of water used at the Heit Sand and Gravel Mine shall not exceed 1.0 <br />acre-feet for dust control, and the total amount of aggregate washed shall not exceed <br />485,000 tons per year, resulting in a consumptive use of 10.7 acre-feet of water. The <br />annual amount of water used at the site for operational purposes therefore shall not <br />exceed 11.7 acre-feet. <br />7. Total consumption at the Heit Sand and Gravel Mine must not exceed the <br />aforementioned amounts unless an amendment is made to this plan. <br />8. Approval of this plan is for the purposes as stated herein. This office must first <br />approve any additional uses for the water. <br />9. All releases of replacement water must be sufficient to cover all out -of -priority <br />depletions in time, place, and amount and must be made under the direction and/or <br />the approval of the water commissioner. The release of replacement water may be <br />aggregated to maximize beneficial use. The water commissioner and/or the division <br />engineer shall determine the rate and timing of an aggregated release. <br />10. The replacement water that is the subject of this plan cannot be sold or leased to any <br />other entity. As a condition of subsequent renewals of this substitute water supply <br />plan, the replacement water must be appurtenant to this site until a plan for <br />augmentation is obtained. All replacement water must be concurrent with depletions <br />in quantity, timing, and locations. <br />11. All diversions shall be measured in a manner acceptable to the Division Engineer. The <br />Applicant shall install and maintain such measuring devices as required by the Division <br />Engineer for operation of this SWSP. In addition, the Applicant shall maintain daily <br />records of all diversions, replacements, and the amount of water used for each <br />particular purpose. The Applicant shall provide a report of these records to the <br />Division Engineer (DivlAccounting@state.co.us), the South Platte River operations <br />coordinator (Brent.Schantz@state.co.us) and the water commissioner (Bill Schneider <br />
