The required fee of $257 for this SWSP renewal has been received (receipt no. <br />3670470). <br />Plan Operation <br />The Heit Sand and Gravel Mine perimeter was lined with a slurry wall in accordance <br />with the State Engineer's Lining Criteria, and was approved by the Division Office on June 24, <br />2009. In accordance with paragraph 21 of the General Guidelines for Substitute Water <br />Supply Plans for Sand and Gravel Pits, the applicant is required to provide replacement for all <br />native ground water remaining within the lined area that is put to beneficial use except for <br />the water removed with the mined product. The water may be removed from within the <br />lined area and returned to the stream system through surface flow or ground water recharge <br />without need for replacement, so long as the operator does not put the water to beneficial <br />use. Replacement shall be made for native ground water that is lost to evaporation. For <br />purposes of this SWSP, it is assumed that all water within the lined area is trapped native <br />ground water. Therefore, this plan will account for depletions resulting from evaporation of <br />exposed water within the lined area. Operational depletions at the site will consist of water <br />used for dust control and for washing of the mined aggregate using an onsite production well. <br />All water used from the production well must be replaced in time, place and amount <br />including water used for washing of mined product. Total depletions for the Heit Sand and <br />Gravel Mine during the period of this SWSP will be replaced by fully consumable water leased <br />from the City and County of Broomfield. <br />In accordance with the letter dated April 30, 2010 from the Colorado Division of <br />Reclamation, Mining, and Safety ("DRMS"), all sand and gravel mining operators must comply <br />with the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations <br />for the protection of water resources. The April 30, 2010 letter from DRMS required that you <br />provide information to DRMS to demonstrate you can replace long term injurious stream <br />depletions that result from mining related exposure of ground water. The DRMS letter <br />identified four approaches to satisfy this requirement.
