Clear Creek County Planning RP"-pi fED <br />21 September, 2015 SEP 21 2015 <br />DIVISION OF RECLAMATION <br />Response regarding Plan of Operations for Teton Drilling MININOAND SAFETY <br />Dixie Mine <br />Comments <br />The subject property is zoned Mining -One (M-1) and allows for mining, prospecting, exploring, milling, <br />processing, and/or placering of mineral resources that is covered by a Reclamation Permit pursuant to <br />the Colorado Mined Land Reclamation Act, or to any land or structure to the extent covered by the Solid <br />Waste Disposal Sites and Facilities Act for which a Certificate of Designation has been approved by the <br />County or, if exempt from a Certificate of Designation, to the extent for which CDPHE has approved the <br />facility design, operations and closure plan and required a financial assurance to secure its closure. <br />Any other facilities shall submit a Reclamation Plan and Financial Guarantee to be approved by the <br />County. <br />Please refer to Impact Operation Submittal in relation to planning comments. <br />Page 4: How is it determined that there is no/will be no acid mine drainage? Furthermore, the applicant <br />states that the proposed disturbance is not located near any water sources, however, Ute Creek runs <br />through the south end of the property (it is noted in Section 6.3.2 of the submittal that all operations <br />will be located 350 to 400 feet from Ute Creek; it should be determined that the operations will not <br />impact this water source — either from mining activity or heavy rainstorm runoff). <br />Page 6: The widening of roads to 20 feet is mentioned. According to Section 703.4 - Roads of the Clear <br />Creek County Zoning Regulations regarding Mining Districts, "All new or reconstructed mine roads must <br />be built to County road design standards for the first thirty (30) feet from the intersection with a County <br />road." As the mine is accessed from Ute Creek Road, which is a County Road, any proposed road or road <br />improvement shall be constructed in conformance with the provisions of the Clear Creek County <br />Roadway Design and Construction Manual. <br />The applicant should first contact the County's Site Development Coordinator and discuss the proposal <br />so it is determined what will be required for construction to meet the provisions of the Manual. <br />Please contact me with any questions you may have regarding this referral. <br />Erik Sampson <br />Clear Creek County Planning Dept. <br />esampson@co.clear-creek.co.us <br />(303)679-2362 <br />
