Mr. Jones <br />Page 15 <br />September 22, 2015 <br />intends on reclaiming the shaft as a part of the mining operation, then it must be within the <br />permit boundary. Also, the Applicant should note that the reclamation of the discovery shaft <br />under this permit will place it under the jurisdiction of the Division. In order to reclaim the <br />shaft, the Division will need additional detail about the shaft including, the specific location, <br />dimensions and a detailed explanation of how the shaft will be reclaimed. In addition, the <br />Division will have to include this component of the Reclamation Plan in the financial <br />warranty calculation. Alternately, the Applicant may remove this component of the <br />Reclamation Plan from further consideration. Landowners do not need Division approval to <br />reclaim historic mine features if they are not within the boundaries of a permitted mining <br />operation, provided that there is not a mining related component to the reclamation work. <br />21. The Division will perform a complete financial warranty calculation once all of the adequacy <br />issues have been addressed. <br />6.3.5 Exhibit E — Map <br />22. Please revise Exhibit E -Map #1 to include an outlined and labeled permit boundary. The <br />permit boundary shall correspond to the 4.5 acres which are being permitted. The permit <br />boundary must encompass all proposed disturbance at the site including roads, processing <br />areas and stockpiles. <br />23. As required by Rule 6.3.5(2)(b), the Mining Plan map must include the names of the <br />owner(s) of record of the surface of the land within 200 feet of the affected area. Please <br />revise Exhibit E -Map #1 to include the names of adjacent landowners if applicable. <br />6.3.6 Exhibit F — List of Other Permits and Licenses Required <br />24. Clear Creek County has provided comments which indicate the proposed road construction <br />must conform to Clear Creek County Zoning Regulations. Please contact the County's Site <br />Development Coordinator to determine the required specifications for road construction. In <br />addition, please provide the design specifications to the Division for inclusion in the permit <br />file and make any necessary revision to the appropriate exhibits. <br />25. Please specify if the Applicant has contacted the Water Quality Control Division of the <br />Colorado Public Health and Environment to determine if a stormwater discharge permit will <br />be required for this operation. <br />6.3.7 Exhibit G — Source of Legal Right To Enter <br />26. The materials provided for Exhibit G do not meet the requirements for demonstration of a <br />legal right to enter the site to conduct mining and reclamation. Proof of a legal right to enter <br />the property may a copy of an access lease, deed, abstract of title, or a current tax receipt. <br />Please provide a valid copy of the legal right to enter the property by Teton Drilling, Inc. <br />
