Mr. Jones <br />Page 13 <br />September 22, 2015 <br />6. The Applicant has specified that downhill portions of the access road will be lined with <br />erosion logs, hay bales and/or erosion nets. Please clarify if these erosion control measures <br />are intended to be placed after mining has ceased and the road has been reclaimed. <br />Otherwise, explain how the road will be utilized with these structures in place. Typically, <br />erosion of roads is controlled with water bars. The Division recommends the use of water <br />bars to control erosion while the mine is active. A copy of a U.S. Forest Service Water Bar <br />Replacement and Construction Guide has been enclosed with this letter. <br />7. Please specify if fuel will be stored on-site. If so, please specify the volume of fuel to be <br />stored and describe the secondary containment measures to be used. All fuel containment <br />structures must have adequate secondary containment to hold at least 110% of the volume of <br />the fuel tank. Adequate secondary containment includes double -walled fuel tanks or lined <br />sumps. <br />8. Please indicate if it will be necessary to create a level work pad in order to set up the <br />processing equipment. If so, please specify the dimensions of the pad and volume of material <br />(cubic yards) which will need to be moved to create a level work space. <br />9. As required by Rule 6.3.3(1)(h), please specify the source of the water to be used for the <br />operation. All water must be obtained from a legal source. <br />10. The Mining Plan states there will be a loss of water between 100 — 400 gallons per day <br />during the crushing and shaker table process. Please clarify if water from the processing <br />circuit will be discharged to the ground surface, or if loss of water is strictly from <br />evaporation and water contained in tails. The processing circuit must be operated as a closed <br />system and all water must be contained within the equipment and secondary tanks. <br />11. The Applicant has stated that lab results were previously provided to the Division which <br />demonstrated that no acid or toxic producing materials would be encountered during the <br />mining operation. Please resubmit all the lab results which demonstrate that the mined <br />materials are not acid producing. <br />12. Pursuant to Rule 3.1.9(2), woody vegetation at the site shall be removed from or <br />appropriately incorporated into the existing topsoil prior to excavation within the affected <br />areas. The Operator should make a reasonable effort to ensure that existing vegetation is put <br />to a beneficial use such as firewood, mulching, lumber, etc. Please specify if trees will need <br />to be removed as a part of the mining operation and describe how the Operator will comply <br />with Rule 3.1.9(2). <br />6.3.4 Exhibit D — Reclamation Plan <br />13. The Reclamation Plan calls for importing topsoil for use during final reclamation. Please <br />identify the source of the topsoil and specify the timing of importation of topsoil. In addition, <br />
