PERMIT #: M-1985-022 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: September 18, 2015 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Ken Tunstall was present on behalf of Eagle Peaks Mining LLC. The Bullger Basin Placer site is <br />located approximately 7 miles northwest of Fairplay, Colorado. The commodity of interest is gold. The site is <br />permitted for 49 acres and the approved post -mining land use is mining and wildlife habitat. <br />The 112 Hard Rock Reclamation Permit for the Bullger Basin Placer was transferred to Eagle Peaks Mining LLC <br />in July 2014. The purpose of the inspection was to verify that the new Operator was in compliance with the <br />approved Mining and Reclamation Plans. The site was actively being mined at the time of the inspection. The <br />Operator informed the Division that this will be the last week the site will be operated this year. The mine is <br />approved for intermittent operation due to the altitude of the site. <br />Availability Of Records: <br />A review of the permit file found that the Division does not have a record of a Mining or Reclamation Plan <br />Map which conforms to the criteria of Hard Rock Rule 6.2, 6.4.3 and 6.4.6. All maps must conform to the <br />following criteria: <br />a) show the name of the Opertor (Eagle Peaks Mining LLC) <br />b) must be prepared and signed by a registered land surveyor, professional engineer, or other quailfied person <br />c) give date prepared <br />d) identify and outline the area that corresponds with the application (permit boundary) <br />e) acceptable range of map scales shall not be larger than 1 inch = 50 feet, nor smaller than 1 inch = 660 feet <br />f) must have a map scale, appropriate legend, map title, and a north arrow <br />The specific criteria for the Mining Plan Map includes the following: <br />a) all immediately adjoining suface owners of record <br />b) the names and location of all creeks, roads, buildings, oil and gas wells and lines, and power and <br />communication lines on the area of affected land and within 200 feet of the all boundaries of such areas <br />c) the existing topography of the area with contour lines of sufficient detail to portray the rate and direction of <br />slope of the affected land <br />d) the total area to be involved in the operation, including the area to be mined and the area of affected lands <br />e) the type of present vegetation covering the affected lands <br />f) Exhibit G Water Information ( sediment ponds and water lines) <br />g) show the owner's name, type of structures, and location of all significant, valuable and permanent man- <br />made structures contained on the area of affected land and within 200 feet of the affected land. <br />The specific criteria for the Reclamation Plan includes the following: <br />a) the expected physical appearance of the area of the affected land, correlated to the proposed mining and <br />reclamation timetables. The map must show proposed topography of the area with contour lines of sufficient <br />detail to protray the direction and rate of slope of all reclaimed lands <br />b) portrayal of the proposed final land use for each portion of the affected lands <br />Page 3 of 7 <br />
