This structure needs to be protected, in accordance with Rules 4.04(5) <br />and (6). <br />Response: The text on Page 3 of Section 2.05.3(3) has been changed to indicate that the 2nd Park <br />Lateral Irrigation Ditch Pipeline location is shown on Map 2.04.7-9. The text has also been <br />changed to include language to address how WFC will comply with Rules 4.04(5) and (6). <br />3) The list of roads in the first paragraph of the Haul Roads portion (Section 2.05.3(3) Page 4) does <br />not match the roads shown on Map 2.05.3(3)-3. The map shows the NW Haul Road, but not the <br />SE. WFUs 3/31/2014 adequacy response for TR -05 indicates that the system of haul roads may <br />be relocated away from the perimeter of the permit area and into the pit/disturbed area. Please <br />update the text and map to be consistent with each other. Please revise the permit when proposed <br />changes to the haul road configurations are known. <br />Response: The text in the first paragraph on Page 4 of Section 2.05.3(3) has been changed so the <br />haul road names match those shown on Map 2.05.3(3)-3. When WFC decides to propose changes <br />to the haul road configurations, they will be submitted in a subsequent revision to the PAP. <br />2.05.4(2)(b) — Reclamation Cost Estimate <br />1) The estimated reclamation costs for the New Horizon North Mine have been updated by the <br />Division to reflect 2014 unit costs. The revised reclamation cost estimate is $5,254,691.17. The <br />detailed cost estimate is attached for your review and comment. <br />Response: A Coal Self -Bond Increase Rider was submitted to the Division on March 11, 2015. <br />A copy of the current Reclamation Cost Estimate (RCE) was submitted and approved under MR - <br />13 and included in Section 3.02.2. <br />2.05.4(2)(d) — Topsoil Redistribution <br />1) The introduction of this section states that the bench 1 material will be placed between the <br />unweathered spoil and topsoil. On page 3, last paragraph, it states that "all of this suitable <br />material [bench I or free dig material] is placed immediately below the topsoil and subsoil in all <br />areas. " Please clam between which soil types the bench I material will be placed. <br />Response: The entire Section 2.05.4(2)(d) narrative has been updated and resubmitted, including <br />clarifying between which soil types the bench 1 material will be placed. <br />2) The text states on page 2 that the bench 1 material will be salvaged separately from the other <br />overburden materials. On page 13, it states that topsoil and the Progresso soils from the Garvey <br />property will also be stored in a separate pile (page 13). No explanation is given in the text <br />where the bench I material, topsoil or the Garvey Progresso soil will be stored.
