(Tri-State) is submitting the enclosed <br />"Application Form for a Revision to a Coal Mining and Reclamation Permit" for a technical revision <br />application on behalf of the Western Fuels -Colorado, A Limited Liability Company (Western Fuels - <br />Colorado) New Horizon North Mine. Tri-State is the parent company of Western Fuels -Colorado. The <br />New Horizon North Mine operates under Division of Reclamation, Mining and Safety (DRMS) Permit <br />No. C-2010-089. <br />This technical revision application is being submitted to address the midterm review adequacy <br />questions and incorporate the responses into the PAP where applicable. Please refer to the attached <br />Change Sheet for a list of maps and pages added or removed by this revision. <br />Tri-State has received your midterm findings document, dated December 19, 2014 and provides <br />the following responses to your adequacy questions on behalf of the Western Fuels -Colorado, New <br />Horizon North Mine. <br />2.03.7(3) — Relationship to Areas Designated Unsuitable for Mining <br />1) On the western side of the permit boundary, a house is on the Garvey Bros Land & Cattle Co. <br />property (#7 on Map 2.03.4-1) that is within 300 feet horizontally of surface mining activities. It <br />is unclear if the house is an occupied dwelling which would require a waiver from the occupant <br />for mining to take place within 300 feet of the dwelling. Please clam in the permit text if the <br />dwelling is occupied. <br />Response: The text in Section 2.03.7(3) has been changed to clarify that the dwelling located on <br />the Garvey Bros.
