accumulations or piles of aggregate, sand, soils, or other earthen materials associated with <br />ordinary mining or stockpiling operations will not be a violation of this provision. <br />e. Purely recreational uses involving, recreational vehicles, <br />moto-cross, snow machines, target- or skeet- shooting, or the pursuing, hunting, shooting, <br />wounding, killing, trapping, capturing, or collecting of animals is not permitted without <br />Lessor's written consent. <br />9. Governmental Approvals. Lessor shall, during the Term of the <br />Lease, refrain from taking any action that could lead to the withdrawal of any existing <br />federal, state and local approvals and permits currently in Lessor's possession. The <br />Lessee shall be responsible for obtaining any other federal, state and local approvals and <br />permits, or any amendments thereto, necessary for the Lessee to conduct a sand and gravel <br />mining operation on the Premises; provided, however, that the Lessor shall cooperate in <br />good faith with the Lessee, including but not limited to the execution of any documents <br />necessary to enable the Lessor to maintain, or obtain revisions to, such approvals and <br />permits. <br />10. Excavation/Reclamation Plan. <br />a. The Lessee has provided Lessor with an acceptable plan for <br />the excavation and reclamation of the Premises, a copy of which has been delivered to the <br />Lessor (the "Plan"). The Plan includes (i) plans for reclaiming those portions of the <br />Premises affected by the Lessee's operations, and (ii) as of the date of delivery to the <br />Lessor, compliance with all applicable laws. <br />b. The Lessee shall file all requisite forms with the Department <br />of Minerals and Geology to allow Lessee to function as a successor operator during the <br />Term of this Lease, including any extensions thereof. The Lessee shall be solely <br />responsible during the Term of this Lease for ensuring that the Plan is maintained in <br />compliance with all applicable laws, and for posting and maintaining any required bonds, <br />and shall be responsible for completing reclamation in accordance with the Plan. <br />C. To the extent permitted by the Plan, Lessee will use dirt, <br />overburden and other materials removed from the Premises to complete reclamation on <br />the Premises. <br />11. Water Augmentation. INTENTIONALLY OMITTED. <br />12. Storage Facility_. INTENTIONALLY OMITTED. <br />13. Insurance. The Lessee covenants and agrees to maintain on the <br />Premises at all times during the Term of this Lease or any renewal hereof a current, paid <br />policy or policies of general comprehensive public liability and property damage <br />insurance insuring the Lessee and the Lessor against any liability arising out of the use, <br />occupancy, or maintenance by Lessee of the Premises and all areas appurtenant thereto <br />used or enjoyed by the Lessee. Such insurance shall be in an amount not less than Two <br />Million Dollars for any one occurrence for both bodily injury and property damage. All <br />J <br />
