through the date of such notice. Notwithstanding any provision to the contrary, the <br />Lessee's use of the Premises and termination of this Lease will be subject to all <br />restrictions contained in the permit issued by the Colorado Division of Mining and Gravel <br />relating to the Premises. <br />29. Assignment and Subletting. The Lessee shall have the right to assign <br />this Lease and/or sublet the Premises to an entity controlled by, controlling, or under <br />common control with, the Lessee (an "Affiliate") without any consent by Lessor. In <br />addition, Lessee shall have the right to assign this Lease and/or sublet the Premises to an <br />entity that is not an Affiliate of the Lessee with the written consent of the Lessor, provided <br />that (i) such consent shall not be unreasonably withheld, conditioned or delayed, and <br />(ii) the Lessee shall remain liable under this Lease notwithstanding any such assignment <br />or subletting; provided, however, in the event the proposed assignee's business operations <br />and financial condition are equal to or better than Lessee's, Lessee shall upon such <br />assignment be released from all obligations hereunder. <br />30. Notices. Any notices required or permitted hereunder shall be in <br />writing and delivered to the other party or the other party's authorized agent, either in <br />person by a courier service providing a delivery receipt or by United States certified mail, <br />return receipt requested, postage fully prepaid, to the addresses set forth hereinafter, or to <br />such other addresses as either party may have designated in writing, and delivered as <br />herein provided: <br />a.
