22. Environmental Conditions. With respect to environmental <br />conditions: <br />a. The Lessor represents that none of the Lessor nor any of its <br />affiliates or agents has placed any of the following, nor to the knowledge of the Lessor <br />does any of the following exist, on the Premises: (i) underground storage tanks, whether <br />in use or abandoned, (ii) asbestos -containing material in any form or condition, <br />(iii) materials or equipment containing polychlorinated biphenyls, or (iv) landfills, <br />surface impoundments, or disposal areas. <br />b. The Lessor has not treated, stored, disposed of, arranged for or <br />permitted the disposal of, transported, handled, or released any substance, including <br />without limitation any hazardous substance, on the Premises, or owned or operated the <br />Premises or any facility thereon (and neither the Premises nor any facility thereon is <br />contaminated by any such substance) in a manner that has given or would give rise to <br />material liabilities, including any liability for response costs, corrective action costs, <br />personal injury, property damage, natural resources damages or legal fees, pursuant to the <br />Comprehensive Environmental Response, Compensation and Liability Act of 1980, as <br />amended ("CERCLA"), the Solid Waste Disposal Act, as amended ("SWADA") or any <br />judicial or administrative orders or determinations, any contractual obligations or <br />common laws concerning public health and safety, worker health and safety, and pollution <br />or protection of the environment, including without limitation all those relating to the <br />presence, use, production, generation, handling, transportation, treatment, storage, <br />disposal, distribution, labeling, testing, processing, discharge, release, threatened release, <br />control, or cleanup of any hazardous materials, substances or wastes, chemical substances <br />or mixtures, pesticides, pollutants, contaminants, toxic chemicals, petroleum products or <br />byproducts, asbestos, polychlorinated biphenyls, noise or radiation, each as amended, <br />now in effect (collectively, "Environmental, Health and Safety Requirements"). <br />C. The Lessor shall be liable for and shall indemnify and hold <br />harmless the Lessee from any and all claims, demands, actions, causes of action, <br />liabilities, damages and expenses, including court costs and reasonable legal fees which <br />the Lessee may suffer, incur or be required to pay as the result of (i) the presence of any <br />substance regulated by any Environmental Health and Safety Requirement that is placed <br />on the Premises by the Lessor at any time and (ii) breach of any of the Lessor's <br />representations, warranties or covenants contained in this Paragraph 22. <br />d. The Lessee shall be liable for and shall indemnify and hold <br />harmless the Lessor from any and all claims, demands, actions, causes of action, <br />liabilities, damages and expenses, including court costs and reasonable legal fees which <br />the Lessor may suffer, incur or be required to pay as the result of the presence of any <br />substance regulated by the Environmental Health and Safety Requirements that is placed <br />on the Premises by the Lessee at any time. Notwithstanding the foregoing, nothing herein <br />shall be deemed to preclude the use or storage in reasonable quantities of materials or <br />liquids, including cleaning products, solvents, lubricants or other such products used in <br />the normal course of Lessee's business as contemplated hereunder. <br />i <br />
