Ms. Angela Aldred <br />September 15, 2015 <br />Page 2 of 6 <br />PLAN OPERATION <br />This pit did not exist, and no ground water was exposed, prior to January 1, 1981. This plan <br />proposes to replace depletions to the Arkansas River that result from historical depletions at <br />the site, evaporation of exposed ground water within Phase I -Parcels 1-3 and Phase II -Parcel 5 <br />of the mine site, totaling 6.1 acres, water removed in mined product, and water used for dust <br />suppression. Fremont Paving is not planning on providing water for batching concrete during <br />this plan year. <br />The 6.1 acres of exposed ground water includes approximately 3.6 acres of ponds in Phase I, <br />approximately 1.0 acre at the sedimentation pond in Phase II, and up to 1.5 acres of <br />dewatering trench. <br />In accordance with the letter dated April 30, 2010 from the Colorado Division of Reclamation, <br />Mining, and Safety ("DRMS"), all sand and gravel mining operators must comply with the <br />requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the <br />protection of water resources. The April 30, 2010 letter from DRMS requires that you provide <br />information to DRMS to demonstrate you can replace long term injurious stream depletions <br />that result from mining related exposure of ground water. According to the renewal request, <br />the long term plan for the site is to construct reservoir liners adequate to prevent the <br />infiltration of tributary ground water. Therefore, please provide an explanation and/or <br />documentation that a financial warranty sufficient to cover the cost of installing a clay <br />liner or slurry wall that meets the Division of Water Resources requirements for <br />preventing ground water exposure has been filed, in accordance with approach no. 3 of <br />the April 30, 2010 letter from DRMS, with the next SWSP renewal request. <br />DEPLETIONS <br />Well permit no. 54064-F (WDID 1406561) was obtained to expose water in this pit. Fremont <br />Paving will continue to mine the site with an estimated annual amount of aggregate to be <br />produced of 200,000 tons. This plan is based on 6.1 acres of exposed water surface area for <br />April 2015 through March 2016, broken down above. The total of 6.1 acres of exposed ground <br />water will result in 21.03 acre-feet of evaporative loss (see attached Table 1). A total of 9.20 <br />acre-feet of water is expected to be consumed by mining operations, consisting of 5.89 acre- <br />feet of water lost in 200,000 tons of aggregate and 3.31 acre-feet used for dust suppression <br />(see attached Table 2). Total operations with evaporation will result in 30.23 acre-feet of <br />consumptive use. Projected uses and consumption during the 2015 - 2016 plan year are as <br />shown in the attached Tables 1, 2, and 3. <br />A Glover analysis was utilized to determine lagged depletions to the stream from the <br />consumptive use of ground water described above.
