PERMIT #: M-1988-090 <br />INSPECTOR’S INITIALS: TOD <br />INSPECTION DATE: August 18, 2015 <br /> <br />Page 4 of 6 <br />CONCLUSION <br /> <br />DRMS is sympathetic and understanding of the Stieghorsts’ concerns and would like to address the previously <br />outlined list: <br /> <br />1) Ingress and egress: The Operator has improved an existing access road to County Road 213 and has been <br />using this as there formal access point. The Operator has stated that this will be there new access point <br />(see the enclosed letter). <br /> <br />2) Fugitive dust: The Division has no jurisdiction over fugitive dust. The Division would advise you to <br />contact Arapahoe County and/or the Colorado Department of Public Health and Environment Air <br />Pollution Control Division regarding fugitive dust. <br /> <br />3) Noise pollution: The Division has no jurisdiction over noise pollution. The Division would advise you <br />to contact Arapahoe County. <br /> <br />4) Security issues: The Division has no jurisdiction over security issues. The Division would advise you to <br />contact local law enforcement immediately if you feel there is an immediate risk to property or human <br />life. <br /> <br />The Divisions records do not specify whether or not land located within the 50-acre area requested to be released <br />has ever been affected by mining operations. During the inspection there was no evidence of excessive erosion <br />(rills, gullies, or sediment fans), caused by a mining related disturbance. Vegetation within the 50-acre area was <br />at least as well established as that on the surrounding lands. Topography within the 50 acres appears to be natural <br />and matches the surrounding topography, if there were reclaimed highwalls the slopes are flatter than the <br />requirements of the approved permit. The Division did not observe any affected land or any unreclaimed land <br />within the 50-acre area addressed through AR-01. Portions of the 50 acres now contain, homes, and other rural <br />residential developments. Based on the conditions observed within the 50-acre area during the inspection, it <br />appears that the requirements of the Act, Rules, and the approved reclamation plan have been complied with, <br />and/or the land has never been affected by mining.
