EXHIBIT G-1 <br />Water Information <br />The co-ordinates for the Amended Smith Pit No. 20 are: <br />N41.00068 Degrees, W107.88564 Degrees (See Exhibit A-1 & C-1) <br />1. There are no Colorado water adjudications recorded in, or within 200 feet of the <br />affected area; <br />2. There are no live streams on, or within 200 feet of the affected area; <br />3. There are no springs, stormwater diversions, or wetlands on, or within 200 feet of <br />the affected area; <br />4. The Smith Pit, complete with this Amendment No. 1, is not expected to directly <br />affect surface or groundwater systems. <br />Moffat County will control stormwater by diverting it away from the natural dry wash <br />channels in the construction areas, and will develop berms, ditches, and settling basins to <br />manage the sediment and to control erosion. This project will not intentionally divert <br />stormwater for beneficial use, or affect the "Waters of the State of Colorado and of the <br />United States." Local surface water may settle in the low areas of the excavations, and, <br />if such water collects in a substantial way, or if it becomes impounded for a substantial <br />period of time, the operator will notes the landowner (BLM) of that event, and will <br />recommend that they apply to the Water Court for a water storage right — then apply the <br />water to beneficial use. <br />In the event that groundwater is exposed, Moffat County will back -fill the excavation so as <br />not to expose groundwater until a well permit has been obtained for the pit well pursuant <br />to CRS 37-90-137. <br />Moffat County will comply with all of the NPDES rules from the Water Quality Control <br />Division at the Colorado Department of Health, where necessary. <br />EXHIBIT G-1 <br />(Water Information) <br />
