Bax 670 <br />Hayden, CO 81639 <br />September 10, 2015 <br />RE: Yoast Mine; Seneca Coal Company <br />Second Quarter 2015 Sediment Pond Inspection Report <br />Permit C-1994-082 <br />Dear Mr. Cowman, <br />The Colorado Division of Reclamation, Mining and Safety (CDRMS) received Seneca Coal Company's <br />second quarter 2015 Sediment pond inspection reports on July 30, 2015 for the Yoast Mine. The Division <br />finds the above reference report to be in compliance with the following CDRMS regulation. <br />4.05.9(17) — Examined at least quarterly by a qualified person designated by the operator, for <br />appearance of structural weakness and other hazardous conditions. <br />4.05.9(17) — A copy of the report shall be submitted to the Division on a quarterly basis. <br />The following sediment ponds were inspected on the respective dates: <br />Pond 010: 6/15/2015, the flume has been pulled out but there is no note about the flume in the report. <br />Pond 10 spillway culvert is showing evidence of rust. <br />Pond 011: No date was recorded on the report. No problems were noted with this pond. <br />Stock Tank 011A: 6/24/2015, No problems were noted with this stock tank. <br />Pond 012: 6/4/2015, no problems were noted with this pond. There is no reference to the flume needing <br />to be cleaned out or leveled as observed by DRMS inspectors. <br />Stock Tank 012A: 6/2/2015, the report notes that the culvert is seeping although the water elevation is <br />below the riser. There is no explanation as to the source or cause of this seep. The Division inspector <br />noted this seeping from the culvert as well. <br />Pond 013: 6/2/105, the report notes the seep below the toe of the embankment. <br />Pond 014: 6/2/2015, No problems were noted on the report with Pond 014. <br />ST -1: 6/24/2015, no problems were noted with this stock tank. <br />Based on the report, is appears that the impoundments inspected were functioning as designed at the time <br />of the inspection. The report differs from observations made by Division inspectors.
