Bax 670 <br />Hayden, CO 81639 <br />RE: Seneca II -W Mine; Seneca Coal Company <br />1st Quarter 2014 Sediment Pond Inspection Report Review <br />Permit C-1982-057 <br />September 10, 2015 <br />Dear Mr. Cowman, <br />The Colorado Division of Reclamation, Mining and Safety (CDRMS) received Seneca Coal Company's <br />second quarter 2015 sediment pond inspection reports on July 30, 2015. The Division finds the above <br />reference report to be in compliance with the following CDRMS regulation. <br />4.05.9(17) — Examined at least quarterly by a qualified person designated by the operator, for <br />appearance of structural weakness and other hazardous conditions. <br />4.05.9(17) — A copy of the report shall be submitted to the Division on a quarterly basis. <br />The following sediment ponds were inspected on the respective dates: Pond 005- 6/2/2015, Pond 006- <br />6/9/2015, Pond 009- 6/2/2015, Pond 015- 6/2/2015, Pond 016- 6/9/2015, Pond 017- 6/9/2015. <br />Based on the reports, is appears that the sediment ponds inspected were functioning as designed at the <br />time of the inspection. The Division found in May 2015 and June 2015 that Pond 016 flume has sediment <br />and vegetation clogging the flume. The report should reflect the actual maintenance issues noted at the <br />ponds. The Division found that overgrown vegetation hampered the access to Pond 006. A large rock on <br />the access road to Pond 015 limited the ability to access the pond via a regular truck, requiring an <br />ATV/UV to access the pond. The maintenance section of the reports should reflect these concerns.
