Box 1525 <br />Dolores, CO 81323 <br />RE: NOTICE OF VIOLATION MV -2015-020, CIVIL PENALTIES, AND CEASE AND <br />DESIST ORDER — PERKINS SANDSTONE, PERMIT NO. M-2006-016 <br />Dear Mr. McClellan: <br />C.R.S. 34-32.5-116(3)(a) and (b), and Permit No. M-2006-016 require you to submit to the Division of <br />Reclamation, Mining and Safety (Division) an annual report and map, and an annual fee each year, due on or <br />before the anniversary date of the permit. The anniversary date of your permit is July 21 st. The annual fee <br />required for your permit is $791.00. As indicated on the approved annual form, the information submitted on the <br />annual report and map must be true and accurate, and acknowledged as such by the signature of an authorized <br />agent. An unsigned annual report is not acceptable. <br />As of the date of this Notice of Violation, the Division has not received your annual fee and/or annual report and <br />map. Therefore, you are in violation of the above-cited statute and the provisions of Permit No. M-2006-016. <br />Pursuant to C.R.S. 34-32.5-124, issues Order to Cease and Desist for ALL mining related activities associated <br />with Permit No. M-2006-016, and assesses Civil Penalties in the amount of $791.00. <br />NOTE: NO PERMITS FOR NEW MINING OPERATIONS SHALL BE GRANTED TO ANY <br />OPERATOR WHO IS CURRENTLY FOUND TO BE IN VIOLATION IN THIS STATE (C.R.S. 34-32.5- <br />120) UNTIL THE VIOLATION IS ABATED. The annual report and fee requirement will be considered <br />submitted when we have received the following components: <br />1. APPROPRIATE 2014 ANNUAL FEE ($791.00) <br />2. COMPLETED 2014 REPORT (SIGNED AND DATED) <br />3. ASSOCIATED 2014 MAP <br />4.
