This affidavit concerns the legal right of the Colorado Milling Company, LLC., a <br />Colorado Limited Liability Company, to enter into and explore, develop, mine, and <br />process the ores located upon the various patented and unpatented lode mining claims <br />situated in the Gold Hill Mining District in Boulder County, Colorado. This statement is <br />submitted in compliance with Rule 6 adopted under the authority of the Colorado Mined <br />Land Reclamation Act, C.R.S. 34-32-108. <br />2. I am a principal in the Colorado Milling Company LLC., a Colorado Limited Liability <br />Company. I have personal knowledge of the rights acquired by said company in the <br />patented and unpatented lode mining claims and patented millsites that are located in the <br />Gold Hill Mining District in Boulder County, Colorado (the "Properties"). In particular, I <br />have personal knowledge of the terms and conditions of the various agreements, notices, <br />easements, warranty deeds, quit claim deeds, covenants, consents and conservation <br />easements granting Colorado Milling Company, LLC. access to the surface and mineral <br />rights of the said Properties. <br />3. I hereby attest, certify and confirm that the Colorado Milling Company, LLC., has <br />acquired the legal right to enter and operate, mine and process ores within said <br />Properties, including without limitation the lode claims and millsites located in the Gold <br />Hill Mining District which are owned by said corporation. <br />4. 1 am unaware of any limitation in the deeds or other documents transferring title which <br />would limit the right of entry to such Properties for the purpose of prospecting, exploring, <br />developing, or mining and extracting precious metals and ores from said <br />Properties for processing at the Gold Hill Mill, other than as specifically set forth in the <br />Conservation Easements, the Prospecting and Mining Covenants and the Trail Easements <br />granted to the Boulder County Parks and Open Space Department. <br />5.
