<br />We have received your letter dated April 14, 2015, requesting a substitute water supply plan in
<br />accordance with 5 37-90-137(11), C.R.S., to cover anticipated depletions at a 21St pit at the Larimer Pit
<br />mining site. Loveland Ready -Mix Concrete, Inc. ("LRM") is currently seeking to add lands to its
<br />mining permit (M-1974-069) and add a 21s' pit at its Larimer Pit operations. Mining at Pit No. 21 is
<br />not anticipated to begin for at least three years, hence there are not anticipated to be any
<br />depletions associated with the proposed Pit No. 21 for at least three years. Since there are no
<br />depletions associated with Pit No. 21 at present and therefore no replacements proposed to be
<br />made, this office does not feel it is appropriate to include Pit No. 21 in a substitute water supply plan
<br />at this time. Instead, this office offers the following comments regarding the proposed depletions
<br />and augmentation replacements associated with Pit No. 21, which we hope will suffice to satisfy the
<br />requirements of the Mined Land Reclamation Board.
<br />Current Operations
<br />The Larimer Pit site currently consists of twenty (20) pits. Pit Nos. 1, 3, 4, 5, 6, 9, and 11 are
<br />augmented under the decree in case no. W-7412. Mining at Pit Nos. 2, 7, 8, 10 and 12 was
<br />completed prior to 1981 and have no depletions that require augmentation. Pit Nos. 16 and 17, now
<br />known as Loveland Ready Mix Pond Nos. 1 and 2, have been lined and do not expose any ground
<br />water. Pit No. 19 has been mined and backfilled.
<br />Pit Nos. 13, 14, 15, 18 and 20 are included in the plan for augmentation decreed in case no.
<br />2000CW142. The decreed augmentation plan relies on LRM's Barnes Ditch inches changed in case no.
<br />2000CW143 and storage releases from Loveland Ready Mix Pond Nos. 1 and 2, both of which are
<br />typically delivered directly to the stream at the reservoir outlet works. During the flooding of the
<br />Big Thompson River in September 2013, the storage ponds were heavily damaged. Replacements for
<br />Pit Nos. 13, 14, 15, and 18 are currently made under the Loveland Ready -Mix Concrete, Inc.
<br />Combined Substitute Water Supply Plan (WDID 0402525), which is currently valid through October 31,
<br />2015, until the necessary repairs can be completed and replacements can again be made pursuant to
<br />case no. 2000CW142. Mining at Pit No. 20 was not anticipated to occur during the plan period and
