TEMPORARY SPECIAL USE AGREEMENT FOR <br />COLORADO PARKS AND WILDLIFE LANDS <br />1. Type of Use: Commercial Use ❑ Special Use A <br />2. Permittee: City of Lamar <br />Period of Use: June 1, 2015 to: May 31, 2016 <br />Starting Date Ending Date <br />4. SWA(s) or portions of SWA(s) where permit is valid: <br />Water use has been arranged through the agreement with LAWMA for <br />providing CPW's share of water (47.68af), to be derived from CPW's water <br />portfolio. Valid only on the former Valco mining site. <br />5. Type of Use Permitted: <br />Use of 47.68af for supplying augmentation water to cover evaporative lose <br />on the three designated ponds at the former Valco mining site, north of <br />Lamar. In exchange, the City of Lamar will cooperate with CPW to allow <br />public access to the site for wildlife related recreation (fishing and watchable <br />wildlife), as soon as possible. Public access will be allowed upon agreement <br />with the City of Lamar as soon as any safety concerns are addressed, <br />sufficient signing is installed, boundaries marked, and as long as access does <br />not interfere with re -vegetation efforts. <br />6. Conditions, stipulations, and/or restrictions for use: <br />Water shall only be used for the purpose of augmentation of the Valco pits. <br />However, some water (if available) may be used for the purpose of irrigating <br />vegetation (as approved) on site to establish sufficient ground cover and <br />assist with site rehabilitation. No access fee may be charged for public use of <br />the site. City of Lamar will complete a "stocking agreement" with CPW to <br />allow stocking of fish for public fishing by CPW only, and allow for such <br />public access. <br />7. Compensation to Colorado Parks and Wildlife: <br />5% of gross or $100 (whichever is greater) ❑ $100 fee ❑ <br />Other (described below) ■ <br />Due to the dual benefit this site will provide to the City of Lamar and CPW, <br />CPW agrees to waive any fee. <br />8.
