Gillham, P.E. <br />August 26, 2015 <br />Page 3 of 5 <br />REPLACEMENTS <br />A portion of the replacement water will be provided by CPW from their water portfolio with <br />LAWMA, and copies of the July 28, 2015 Temporary Special Use Agreement between Lamar <br />and CPW and the August 2, 2000 Water Management Agreement between CPW and LAWMA, <br />are attached. According to the agreements, 47.68 acre-feet of fully consumable replacement <br />water will be provided to Lamar for the plan period from June 1, 2015 through May 31, 2016. <br />The remaining 47.67 acre-feet of replacement water will be provided by excess accretions to <br />the Arkansas River which results from the operation of Lamar's Rule 14 Plan, SWSP, and plan <br />for augmentation decreed by the Division 2 Water Court in case no. 05CW107-A. The <br />accretions are given in the attached Attachment 5, which is a projection of Lamar's <br />depletions and accretions from June 2015 through May 2016. <br />CONDITIONS OF APPROVAL <br />This substitute water supply plan is hereby approved pursuant to Section 37-90-137(11), <br />C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of June 1, 2015 through May 31, 2016, unless <br />otherwise revoked, modified, or superseded by decree. Should an additional SWSP be <br />requested, such renewal request must be submitted to this office with the statutory <br />fee of $257 per gravel pit at least 90 days prior to the expiration date of this plan. <br />Once reclamation is complete and the release has been obtained from DRMS, the <br />applicant must submit the SWSP renewal pursuant to C.R.S. 37-90-308(4) and the <br />application filed in Division 2 Water Court case no. 13CW3060. Accordingly, an <br />SWSP renewal submitted under C.R.S. 37-90-308(4) may only include replacement <br />sources that are also included in the pending plan for augmentation in Division 2 <br />Water Court case no. 13CW3060. <br />2. Any renewal request submitted for this SWSP must include a lagging analysis which <br />incorporates the distance from the centroids of the North Gateway Park Ponds to <br />the Arkansas River, as discussed above. <br />3. Well permit no. 52184-F has been obtained for exposed pond surface area of the North <br />Gateway Park Ponds in accordance with §37-90-137(2) and (11), C.R.S. <br />4. Each pond must be equipped with a staff gage surveyed properly, related to the stage - <br />area -capacity table for the pond in order to account for refill volume in compliance <br />with the Division Engineer's Functional Standards for Reservoir Stage/Area/Capacity <br />Data . <br />5.
