Daniel J. Gillham, P.E.
August 26, 2015
REPLACEMENTS
A portion of the replacement water will be provided by CPW from their water portfolio with
LAWMA, and copies of the July 28, 2015 Temporary Special Use Agreement between Lamar
and CPW and the August 2, 2000 Water Management Agreement between CPW and LAWMA,
are attached. According to the agreements, 47.68 acre-feet of fully consumable replacement
water will be provided to Lamar for the plan period from June 1, 2015 through May 31, 2016.
The remaining 47.67 acre-feet of replacement water will be provided by excess accretions to
the Arkansas River which results from the operation of Lamar's Rule 14 Plan, SWSP, and plan
for augmentation decreed by the Division 2 Water Court in case no. 05CW107-A. The
accretions are given in the attached Attachment 5, which is a projection of Lamar's
depletions and accretions from June 2015 through May 2016.
CONDITIONS OF APPROVAL
This substitute water supply plan is hereby approved pursuant to Section 37-90-137(11),
C.R.S., subject to the following conditions:
1. This SWSP shall be valid for the period of June 1, 2015 through May 31, 2016, unless
otherwise revoked, modified, or superseded by decree. Should an additional SWSP be
requested, such renewal request must be submitted to this office with the statutory
fee of $257 per gravel pit at least 90 days prior to the expiration date of this plan.
Once reclamation is complete and the release has been obtained from DRMS, the
applicant must submit the SWSP renewal pursuant to C.R.S. 37-90-308(4) and the
application filed in Division 2 Water Court case no. 13CW3060. Accordingly, an
SWSP renewal submitted under C.R.S. 37-90-308(4) may only include replacement
sources that are also included in the pending plan for augmentation in Division 2
Water Court case no. 13CW3060.
2. Any renewal request submitted for this SWSP must include a lagging analysis which
incorporates the distance from the centroids of the North Gateway Park Ponds to
the Arkansas River, as discussed above.
3. Well permit no. 52184-F has been obtained for exposed pond surface area of the North
Gateway Park Ponds in accordance with §37-90-137(2) and (11), C.R.S.
4. Each pond must be equipped with a staff gage surveyed properly, related to the stage -
area -capacity table for the pond in order to account for refill volume in compliance
with the Division Engineer's Functional Standards for Reservoir Stage/Area/Capacity
Data .
5. No more than 30.2 acres (23.2 acres of post -1981 exposure) may be exposed at the
North Gateway Park Ponds during this plan year without first obtaining a new SWSP.
Documentation of pond size may be required by the Division Engineer in the form
of an aerial photo evaluation or survey by a Professional Land Surveyor during the
plan year or in years covered by subsequent renewals of this plan.
of C
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3589 www.water.statexo.us-Rc( y4 o
i
*1876*
