!11111111111111111111111111Sol it' 111111111111111111 <br />�il4.8 U/92/ 0 01:3W Oat <br />of 8 R.40.06 o e.so K e.0@ pro ATTACHMENT A <br />WAi'ER MAYA!QEMENT AGREEMENT <br />THIS AGREEMENT, made this 2ND clay of agzLu , 2000 between the State of <br />Colorado acting by and through the Department of Natimat Resources for the use and benefit <br />of the Division of Wildlife, hereinafter referred to as "the State" or "DOW," whose address <br />is 6060 Broadway, Denver, Colorado 80216, and Lower Arkansas Water Management <br />Association, hereinaer referred to as "LAWMA," whose address is P.O. Box 1161, Lamar, <br />Colorado 81052. <br />WHEREAS, iEREAS, the State has an option to purchase 4720 shares of capital stock in the Lamar <br />Canal and Irrigation Company (Lamar Canal), 408 shares of capital stock in the Fore Bent <br />Canal Company (Fort Bent Canal), and 376 shares of stock in LAWMA which are currently <br />used to krigm the property known as the Center Farm pursuant to a Real Estate Agreement <br />with ROth and Sons, Inc., dated March 9, 2000, and <br />WHEREAS, the transferable consumptive use water from the 4720 shares of Lancer Canal <br />has been estimated at approvdmately 3756 acre-feet per year and fxom the 408 shares of the <br />Fort Bent has been estimated at approximately 305 acre-feet per year for the period of 1950- <br />1998 (DOW Water Shares), and further the LAWMA shares are estimated to be equivalent to <br />3 76 acre-feet of water per year, and <br />WHEREAS, the exercise of the option to purchase by DOW is contingent on the seccessffnl <br />negotiation of a written agreement between the State and LAWMA; and <br />WHEREAS, the DOW Water Shares will be used for the protection and management of the <br />.Ylldl;fe resources in the Arkansas River basin, which may include in some combination <br />those using the Great Plains Reservoirs, John Martin Reservoir, Las Animas Hatchery, <br />several state wildlife areas, and other locations iu the basin; and <br />WHEREAS, in 1997, the DOW purchased the X -Y Rauch from LAWMA for wildlife <br />management purposes along with the right to pump up to 1475 acre-feet of water on 676 <br />acres of land on the Ranch for which LAWMA is responsible for replacement of depletions; <br />this obligation by LAWMA is met by existing water rights in LAWMA's plan and the <br />replacement of the depletions from such X -Y pumping is not considered as a delivery for <br />wildlife purposes under this agreement-, and <br />V,gMIREAS, LAWMA owns or lcases, for the benefit of its members, certain water rights <br />diverting from the Arkansas River in Water District 67 including the X -Y Ditch ;vianvel <br />-1- <br />
