The Lamar East Gravel Pit has been <br />renamed as the Lamar North Gateway Park Pond Nos. 1, 2 and 3 ("North Gateway Park <br />Ponds"), and will be referred to as such with the renewal of this SWSP. The previous SWSP <br />was approved pursuant to Section 37-90-137(11), C.R.S., with an expiration date of May 31, <br />2015. On December 18, 2013 Lamar made application for approval of a plan for augmentation <br />and appropriative right of exchange concerning the North Gateway Park Ponds in Division 2 <br />Water Court case no. 13CW3060. Accordingly, Lamar is now requesting an SWSP pursuant to <br />Section 37-92-308(4), C.R.S., and notice of such request was sent on April 16, 2015 to all <br />opposers listed in Division 2 Water Court case no. 13CW3060. The State Engineer's Office <br />("SEO") did not receive comments during the statutory 30 -day comment period. The required <br />$300 fee has been paid under receipt no. 3669299. <br />According to the April 16, 2015 SWSP request, Lamar is proposing to utilize water provided by <br />Colorado Parks and Wildlife ("CPW") by agreement dated July 28, 2015. Said water will be <br />from the CPW water portfolio available from the Water Management Agreement between <br />CPW and the Lower Arkansas Water Management Association ("LAWMA") and is not listed as a <br />source of replacement water in the application for approval of a plan for augmentation and <br />appropriative right of exchange in Division 2 Water Court case no. 13CW3060; therefore, this <br />SWSP request cannot be approved pursuant to Section 37-92-308(4), C.R.S., and has instead <br />been evaluated and approved pursuant to Section 37-90-137(11), C.R.S. <br />9 <br />1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3589 www. water. state. co. us I N C ] 0 <br />
