XII. Post-mining Land Use

The post-mining land use is discussed under Section 4.2 of Vol. IV of the permit
application.

1.Cropland, rangeland and wildlife habitat are the currently approved post-mining land
uses. These land uses meet the criteria of Rule 4.16.3.

XIII. Protection of Fish, Wildlife and Related Environmental Values

Section 4.6 of Vol. IV of the permit application discusses the protection of fish, wildlife
and related environmental values.

1.The primary mitigation measure for wildlife is the successful achievement of
reclamation on affected areas. Wildlife habitat is a planned post mine land use.
Trapper has selected appropriate plant species and distributions to benefit fish and
wildlife. Other mitigation measures include keeping mine disturbance to a minimum,
regulated hunting on mine property, wildlife harassment prevention, proper livestock
grazing management, fire control, appropriate pesticide and herbicide use, raptor nest
buffer zones, powerline construction designed to protect raptors, and required
monitoring and notification of the Division of threatened or endangered species
identified during the course of mining. (4.18)

XIV. Protection of Underground Mining

1.The Division previously approved a variance to allow surface coal mining activities
to be conducted within 500 feet of an active or abandoned underground mine. The
Williams Fork Mines (Permit No. C-1981-044); A.K.A. Empire Mine) extends
underneath the west end of Trapper Mine. More than 800 feet of vertical separation
exists between Trapper's surface pit floors (now reclaimed) and Williams Fork Mines
underground workings. Trapper will not be conducting any further mining on the
west end; the area has been fully reclaimed (4.19(1) and 4.22.4(1)).

XV. Subsidence Control

No specific approvals are granted to the applicant under this section.

XVI. Concurrent Surface and Underground Mining

No specific approvals are granted to the applicant under this section.

XVII. Operations on Alluvial Valley Floors

Operations on alluvial valley floors are discussed in Section 4.8.4 of Vol. IV of the
permit application.

Criteria for Alluvial Valley Floor Determination

39

Trapper MineJuly 9, 2013
