MEMORANDUM OF UNDERSTANDING
Between the
UNITED STATES DEPARTMENT OF ENERGY
And the
COLORADO DIVISION OF RECLAMATION, MINING AND SAFETY
This Memorandum of Understanding (MOU) is entered into by the Department of Energy Office
of Legacy Management, hereafter referred to as DOE, and the State of Colorado, acting by and
through the Department of Natural Resources, Division of Reclamation, Mining and Safety
(DRMS), hereinafter collectively referred to as the Agencies.
The DOE Uranium Leasing Program (ULP) manages approximately 25,000 acres of withdrawn
lands located within the Uravan Mineral Belt in western Colorado for the purpose of mining
uranium and vanadium ores as established under various Public Land Orders. Mining operations
include exploration, mine development, mineral extraction, and reclamation.
I. Purpose
The purpose of this MOU is to:
A. identify the individual and shared roles and responsibilities of the Agencies with respect
to the DOE ULP;
B. promote Agency coordination in the regulation of uranium and vanadium prospecting and
mining operations located on ULP lands;
C. assure that adverse environmental effects of uranium and vanadium prospecting and
mining, hereinafter collectively referred to as "mining operations" are minimized or
eliminated and that mining operations on ULP lands throughout the State of Colorado are
reclaimed to a beneficial use;
D. simplify the administration of surface and underground mining and reclamation
requirements for uranium and vanadium mining operations on ULP lands to which the
state statutes and regulations apply;
E. achieve coordination between the Agencies in administering the statutes and regulations
governing uranium and vanadium mining operations, financial assurances and
reclamation, and;
F. eliminate duplication, whenever possible, between the State and DOE in implementing
State and Federal requirements.
This MOU applies to mining operations on DOE managed lands under the ULP. Colorado
statutes (C.R.S. 34-32-101 et seq.) provide for and indicate the need for coordination with
Federal agencies having jurisdiction over mining operations.
