MEMORANDUM OF UNDERSTANDING <br />Between the <br />UNITED STATES DEPARTMENT OF ENERGY <br />And the <br />COLORADO DIVISION OF RECLAMATION, MINING AND SAFETY <br />This Memorandum of Understanding (MOU) is entered into by the Department of Energy Office <br />of Legacy Management, hereafter referred to as DOE, and the State of Colorado, acting by and <br />through the Department of Natural Resources, Division of Reclamation, Mining and Safety <br />(DRMS), hereinafter collectively referred to as the Agencies. <br />The DOE Uranium Leasing Program (ULP) manages approximately 25,000 acres of withdrawn <br />lands located within the Uravan Mineral Belt in western Colorado for the purpose of mining <br />uranium and vanadium ores as established under various Public Land Orders. Mining operations <br />include exploration, mine development, mineral extraction, and reclamation. <br />I. Purpose <br />The purpose of this MOU is to: <br />A. identify the individual and shared roles and responsibilities of the Agencies with respect <br />to the DOE ULP; <br />B. promote Agency coordination in the regulation of uranium and vanadium prospecting and <br />mining operations located on ULP lands; <br />C. assure that adverse environmental effects of uranium and vanadium prospecting and <br />mining, hereinafter collectively referred to as "mining operations" are minimized or <br />eliminated and that mining operations on ULP lands throughout the State of Colorado are <br />reclaimed to a beneficial use; <br />D. simplify the administration of surface and underground mining and reclamation <br />requirements for uranium and vanadium mining operations on ULP lands to which the <br />state statutes and regulations apply; <br />E. achieve coordination between the Agencies in administering the statutes and regulations <br />governing uranium and vanadium mining operations, financial assurances and <br />reclamation, and; <br />F. eliminate duplication, whenever possible, between the State and DOE in implementing <br />State and Federal requirements. <br />This MOU applies to mining operations on DOE managed lands under the ULP. Colorado <br />statutes (C.R.S. 34-32-101 et seq.) provide for and indicate the need for coordination with <br />Federal agencies having jurisdiction over mining operations. <br />Page 1 of 8 <br />
