BOX 33695 DENVER, COLORADO 80233-0695 <br />August 14, 2015 <br />Mr. Eric Mink <br />Water Quality Control Division <br />Colorado Department of Public Health and Environment <br />4300 Cherry Creek Drive South <br />Denver, Colorado 80246-1530 <br />RE: CDPS Permit #CO -0000213 <br />New Horizon Mine (Outfalls 007 and 013) <br />Whole Effluent Toxicity Testing — No Pattern of Toxicity <br />Dear Mr. Mink: <br />303-452-6111 <br />Two consecutive accelerated Whole Effluent Toxicity (WET) testing results demonstrate <br />"no pattern of toxicity" for Outfalls 007 and 013 at the Western Fuels — Colorado, A Limited <br />Liability Company (Western Fuels -Colorado) New Horizon Mine (CDPS Permit #CO -0000213). <br />Tri-State Generation and Transmission Association, Inc. (Tri-State) is the parent of Western <br />Fuels -Colorado. The original notification of WET test results was submitted to the Division on <br />July 13, 2015, with an updated notification on July 23, 2015. <br />The facility collected accelerated WET sample sets for each outfall for analysis by The <br />SeaCrest Group, Louisville, Colorado, during July 2015. The samples were analyzed for <br />potential toxicity to the fathead minnow (Pimephales promelas) for Outfall 007 and <br />Ceriodaphnia dubia for Outfall 013, as the routine test results indicated more sensitivity to the <br />respective species. No statistically significant toxicity to these species was found in the two <br />consecutive accelerated sampling events for these outfalls. Enclosed are the summary CDPS <br />WET Test Report Forms and chains of custody for these tests. <br />Based on the demonstration of "no pattern of toxicity", the June 2015 WET test results <br />reflect anomalous conditions. As a result, Part I.A.4b.c.i. of the permit states that "the toxicity <br />episode is considered to be ended and routine testing is to resume."
