Scott <br />Environmental Projection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Notice of 112 Construction Materials Reclamation Permit Application Consideration Asphalt Specialties Co., <br />Inc., Chavers Mining Resource, File No.,M-2015-030,(HC #68694) <br />Dear Mr. Scott: <br />Thank you for your correspondence dated July 29, 2015 (received by our office on August 4, 2015) regarding the <br />above referenced project. <br />A search of our database indicates that no cultural resource inventories have been conducted in the vicinity of the <br />proposed permit area and no historic properties have been recorded therein. Our files contain incomplete <br />information for this area, as most of Colorado has not yet been inventoried for cultural resources. As a result, there is <br />the possibility that as yet unidentified cultural resources exist within the proposed permit area. Should human <br />remains be discovered during ground disturbing activities, the requirements under Colorado Revised Statute 24-80 <br />part 13 apply and must be followed. <br />If this project falls under the jurisdictional authority of a Federal agency such as, but not limited to, the US Army <br />Corps of Engineers, Section 106 of the National Historic Preservation Act as set forth in 36 CFR Part 800 <br />("Protection of Historic Properties") may apply. Section 106 requires that the agency identify historic properties (i.e. <br />cultural resources that are eligible to be listed in the National Register of Historic Places) located within the area of <br />potential effects and determining whether the undertaking will have an effect upon such properties. The State <br />Historic Preservation Office, Native American tribes, representatives of local governments, and applicants for federal <br />permits, licenses or other approval are entitled to consultative roles in this process. <br />We thank you for the opportunity to comment.
