information gathered over the past 12 years confirms this (see Appendix J-1, J-2 <br />of the 2nd Permit Renewal, and the Annual Hydrology and Reclamation <br />Reports). Treatment of the sub -surface and ground water will not be necessary. <br />Appendix M-1, Existing Surface Features Map, shows the location of any <br />significant water diversion, collection, conveyance, storage and discharge <br />structures (these include the perimeter ditches, the Dugout Pond and Sediment <br />Pond 2 as permanent structures). Due to the highly permeable sand mantle that <br />surrounds the site, these structures do not convey/hold water for any period of <br />time. The design of the perimeter ditch is to capture and carry water from all <br />areas within the site which have been disturbed by mining and subsequent <br />reclamation activity to Sediment Pond 2. <br />While it was concluded by Coors, the Division and the Department of Public <br />Health and Environment in 1990 that a NPDES permit was not needed for this <br />site, since there has been no discharge, events subsequent to that last permit's <br />cancellation resulted in Coors filing to obtain a new permit (# COG -850038). <br />This new permit falls under the Colorado general permit COG -850000 FOR <br />FACILITIES "engaged in mining and processing of coal". As such it expires <br />(unless renewed) with that general permit on June 30, 1997. <br />This new permit was obtained in conjunction with the revised Drainage Plan <br />(Technical Revision #28, approved 2/13/95) when it was concluded, based on the <br />best information available at the time, that the changes to drainage patterns <br />within the permit area, combined with the elimination of both the Evaporation <br />Ponds and the active plan to control water flow through the use of the mine pits, <br />could result in flows to the remaining sedimentation pond in excess of its design <br />capability, and thus a potential discharge from the permit area (which would <br />necessitate the NPDES permit). Coors intends to continue to monitor this <br />situation and to collect date which would either justify continued renewal of the <br />NPDES permit, or its further cancellation, based on a continued lack of any <br />historical discharge from the permit area. <br />At the time of the second permit renewal, Coors had submitted, and was awaiting <br />formal approval from the Division I Water Court for a plan for water <br />augmentation. The plan had been filed to augment calls on tributary water <br />resulting from the consumptive use of water in conjunction with the mining <br />operation. Subsequent decisions by Coors to cease all mining operations at the <br />site and move to reclamation activities only resulted in the closing of sumps and <br />the closing of the pits to levels on longer in contact with tributary waters. All <br />remaining water use requirements at the site are being satisfied by the single <br />remaining Laramie -Fox Hills well. The Water Court agreed to the withdrawal of <br />the pending water augmentation plan on 7/31/91. <br />4.
