PERMIT �-: M-2010-071 <br />INSPEC'TOR'S INITIALS: MAC' <br />INSPECTION DATE: JLlly 30, 2015 <br />Division. <br />S. Mining out of sequence, i.e. excavating the pit prior to installing the slurry wall. <br />Failure to follow the approved Mining Plan could result in a possible violation of C.R.S. 34-32.5-124 for failure <br />to comply with the conditions of an order, permit, or regulation. Any person who violates any provision of a <br />permit issued under Article 32.5 shall be subject to a civil penalty of not less than one hundred dollars per day <br />nor more than one thousand dollars per day for each day during which the violation occurs. The Operator <br />informed the Division that an Amendment Application was being prepared to address the changes to the <br />Mining and Reclamation Plans. The Division received the Amendment Application on August 5, 2015. <br />The failure to follow the approved Mining Plan has been cited as a problem; please see the first page of this <br />report for additional information. <br />Hydrologic Balance: <br />As noted above, the Operator is currently dewatering the active pit and the processing area. The Division does <br />not currently have a record of a valid Substitute Water Supply Plan or well permit to account for the <br />evaporative depletions associated with exposing groundwater. In addition, the Operator committed to <br />monitoring groundwater levels in seven piezometers. Water level measurements were to be collected <br />quarterly and submitted to the Division with the Annual Report. To date, the Division has not received any <br />groundwater monitoring data. The failure to provide groundwater monitoring data and documentation <br />regarding evaporative depletions associated with exposed groundwater has been cited as a problem; please <br />see the first page of this report for additional information. <br />Revegetation: <br />The Division observed canada thistle, diffuse knapweed, field bindweed, and perennial sowthistle on the <br />overburden and topsoil stockpiles, as well as on the perimeter of the pit. In addition, the Division observed <br />purple loosestrife at the southwest corner of the processing area, adjacent to the conveyor line. The purple <br />loosestrife was found in a stand of cattails and the extent of the purple loosestrife was limited to a small area. <br />Purple loosestrife is a List A Noxious weed. Pursuant to the Colorado Noxious Weed Act, all species on the List <br />A are considered to be rare noxious weeds and must be eradicated wherever they are detected. <br />A review of the permit file found that the approved weed control plan needs to be updated to include Purple <br />loosestrife. In addition, the weed control plan must be revised to include a list of the specific control measures <br />to be used to control noxious weeds, a monitoring plan that specifies how frequently the Operator will <br />monitor for noxious weeds, and a post-treatment monitoring plan to determine the effectiveness of control <br />efforts. The presence of noxious weeds on the mine site has been cited as a problem; please see the first <br />page of this report for additional information. <br />Signs and Markers: <br />The permit sign was clearly posted at the site entrance and the boundary of the affected area was delineated <br />with fence lines as required by Rule 3.1.12. <br />Page 4 of 7 <br />
