The <br />Keenesburg Mine site is in an area currently zoned as Agricultural in unincorporated Weld County <br />as shown on the Weld County Online Mapping system (https://maps.co.weld.co.us). Coors Energy <br />Company has a current Use by Special Review Permit (USR-1160) which supersedes the previous <br />Special Use Permit (SUP-386AM) and allows for the site to be used as a Coal Mine and Waste <br />Disposal Facility under Section 23-3-40 of the Weld County Charter and Code (Uses by special <br />review of lands zoned as agricultural, http://colocode.com/weldpdf.html). <br />The Keenesburg Mine USR-1160 (attached) shows the main access road and all facilities that will <br />be <br />Land Reclamation Board (MLRB) has jurisdiction over all reclamation activities. The only <br />mention of reclamation in USR-1160 states that fences must by maintained until the property is <br />reclaimed. Because reclamation activities are governed by MLRB, the reclamation must only <br />comply with the MLRB Mining and Reclamation Permit (C-1981-028). <br />Additionally, the proposed alternate use of the facilities affected by TR45 in support of ranching <br />and oil and gas production are allowed for under the current zoning of the property. Section 23-3- <br />30 of the Weld County Zoning Code (Accessory Uses) allows for any buildings or structures that <br />sory to the Uses Allowed by Right in the Agricultural Zone <br />as detailed in Section 23-2-20. Both oil & gas production facilities (23-2-20.I) and <br />ranching (23-2-20.C) are uses allowed by right.
