COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Departm—it of N.atxai R S_ rct <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />August 5, 2015 <br />Mr. Ken Coulson <br />Coulson Excavating Company <br />3609 North County Road 13 <br />Loveland, CO 80538 <br />RE: Kirtright Pit; DRMS File No. M-1986-123; Follow-up on Unresolved Problems <br />Dear Mr. Coulson, <br />During the inspection conducted on July 11, 2014 the Division cited a problem pursuant to <br />Construction Materials Rule 3.1.3 for failure to complete reclamation within five years from the <br />date mining ceases. The Operator was to submit an augmentation plan to the appropriate water <br />court for approval by February 16, 2015 and provide written documentation demonstrating the <br />augmentation plan has been filed in court. The Division has received notice that the Office of the <br />State Engineer has extended the deadline for filing an augmentation plan to December 31, 2015. <br />Therefore, the new deadline for providing evidence that an augmentation plan has been filed is <br />December 31, 2015. <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to <br />the Division by the date provided above, the listed problems could be escalated to the level of <br />possible violations and would then be referred to the Mined Land Reclamation Board for further <br />action. <br />If the problem has already been remedied, please provide evidence of its completion.
