PERMIT #: M-1977-208 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: July 2, 2015 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Wayne Stoughton and Maribel Aguilos were present on behalf of CEMEX and Robin Bay was present <br />on behalf of Habitat Management. The Lyons Quarry is located approximately 2 miles east of Lyons, Colorado. <br />The site is permitted for 979.54 acres and the post -mining land use is rangeland. <br />On May 15, 2015, the Division received an application for a Technical Revision (TR13). The Operator submitted <br />TR13 to address the Environmental Protection Agency requirements for National Emission Standards for <br />Hazardous Air Pollutants (NESHAP). In order to comply with the NESHAP requirements the Operator has <br />installed an Activated Carbon Injection System (ACI) to reduce mercury emissions from the kiln flue gas. In <br />addition, a Lime Injection System (LIS) has been installed to allow for alternative monitoring for HCL emissions. <br />The ACI and LIS operate as dry bulk feed systems and consist of two silos and pump building for the lime which <br />will be delivered directly into effluent gas streams of the kiln. Also, TR13 addresses the installation of a <br />Selective Non -catalytic Reduction (SNCR) in order to comply with the EPA Consent Decree No. 09-cv-00019- <br />MSK-MEH. The SNCR system will control NOx emissions by injecting aqua ammonia directly into the kiln Pre - <br />Heat Tower. The SNCR system consists of a 35,000 gallon storage tank and associated piping to deliver aqua <br />ammonia and water lines for two emergency eye washing stations. The structures will be located at the <br />cement plant. The financial warranty was increased by $127,127.00, for a total financial warranty of <br />$8,953,127.00. The increased financial warranty was accepted by the Division on July 13, 2015. <br />Hydrologic Balance: <br />During the inspection, the Division visited each of the groundwater monitoring points. All of the wells were <br />securely capped and locked. <br />Reclamation Success: <br />The Division inspected C -Pit, the approved location for disposing of Cement Kiln Dust (CKD). The Operator <br />continues to backfill the C -Pit with CKD. As a result, the highwall which was present on the west side of C -Pit <br />has been eliminated. The Operator is able to control the water level in the C -Pit by pumping water, via a <br />floating pump, from the C -Pit to the cement plant. The C -Pit was not being pumped during the inspection; <br />however, sprinklers around C -Pit were being used for dust suppression. <br />Revegetation: <br />The Division observed thistle and field bind weed throughout the site. The Operator uses an independent <br />contractor to control weeds at the mine. However, a review of the permit file found the Operator does not <br />have an approved weed control plan. The presence of noxious weeds and the lack of an approved weed <br />control plan has been cited as a problem; please see the first page of this report for additional information <br />Page 2 of 4 <br />
